Lundström demands Pirate Bay retrial

Carl Lundström, who received a one-year prison sentence following the trial of the four men behind the free file-sharing website The Pirate Bay, has demanded that the case be retried in the Stockholm District Court.

Court judge Tomas Norström has a conflict of interest, claimed his defending counsel Per E Samuelson in a formal deposition to the Svea Court of Appeal.

The news of Norström’s membership of associations concerned with copyright issues drew widespread attention last week. He is a member of the Swedish Copyright Association, among other organisations, as are Henrik Pontén, Peter Danowsky and Monique Wadsted, the lawyers representing the copyright holders.

Ifpi, the organisation that represents the recording industry and brought the action against The Pirate Bay, supports the copyright association.

According to Samuelson, Norström’s involvement poses a conflict of interest. Moreover, he was wrong not to have said anything about his position.

“Tomas Norström should have reported these circumstances to the parties and their lawyers and given them the chance to raise a formal objection,” writes Samuelson in his deposition.

In his forties, Lundström was the oldest of the four Pirate Bay defendants and the most public. He made his fortune when the Wasabröd family business was sold. He then owned the telecom company Rix Port80, which was subsequently sold to Phonera.

One may like TPB or not. But a biased trial is something that Sweden does not need. So go for it!

BTW: I don't think that "Pirate Bay Millionaire" is a neutral headline. It implies that the guy made the money with TPB and that's not correct. In fact, him having any money or not has notghing to do with a judget that didn't disclose a relevant conflict of interest.

I personally think that pirate bay are at least partially guilty and that people who download are also partly to blame.

However, in any court case the judge, prosecution and jury should have no links to any form of direct or indirect possible influence, so therefore there needs to be a retrial, so that at least justice can be seen to be done, wether found guilty or innocent.

Justice demands a retrial.

I just read today that one of the anti-piracy organizations of which this judge is a member, is very small and close-knit. It consists of only about 30 people, four of which are the ones who brought the case against TPB. There's no possible way he could not have been in contact with them. And if that weren't enough to prove his bias, this is the same judge who ordered the raid on TPB's offices a couple of years ago.

Don't expect that the millions of us who are interested in Sweden, its culture and the very cool place it is, from around the world are going to go out and learn Swedish. Unfortunately, the entire world doesn't communicate in Swedish but that's a pity and why we all speak English and crazy gEEk. Most speak more than one, but the ones we need to survive. You need to get on a plane, inject a little flavor and tolerance into your mind and body and save your naivety and pity for perhaps someone's injustice.

Im in agreement with Sebastian, the local is by far one of the better mainstream newspapers ive ever read on a regular basis, specially in the eu, I appreciate how they go out of the way to be non-biased and how they arent too proud to correct their mistakes, and since they opened up their comments I feel they are doing a good service to not only present the news but to also give us a feel for what others opinions might be. The judge was clearly biased, regardless of his affiliations. He repeatedly allowed the prosecution to introduce surprise evidence in breach of legal procedure - that alone is enough for a retrial.

Remember also that they were charged with 'enabling' not supplying - which is no more than Google does if you add the “filetype:torrent” argument.

In fact, just by publishing this comment, under this ridiculous law The Local could be accused of the same thing!
