Juvenile care for Stureby teen killing

Published: 26 Oct 09 16:15 CET | Print version
Online: http://www.thelocal.se/22890/20091026/

The two teenagers found guilty for the death of 15-year-old Therese Johansson Rojo in the Stockholm suburb of Stureby last summer have each been sentenced to 20 months in institutional juvenile care.

In September, Södertörn District Court found the two teens, a 16-year-old boy and a 16-year-old girl, guilty of having killed the girl.

The boy was found guilty of murder and the girl of instigation of murder. The court was unable to rule on what punishment the teens would receive at the time, however, instead needing to wait for the completion of a psychiatric evaluation.

The evaluation showed that neither of the youths suffered from a psychiatric disorder, meaning that the resulting punishment would be institutional juvenile care.

The 16-year-old boy killed Johansson Rojo one night in June by hitting her in the head with a club, strangling her, and leaving her for dead. She later died from her injuries.

The boy carried out the killing at the behest of the girl charged in the case after she threatened to break up with the boy unless he killed Johansson Rojo, who had allegedly told several people that she was also in a relationship with the boy.

Attorney Claes Borgström, who defended the 16-year-old boy, argued during Monday’s hearing about what sort of punishment would be suitable for his client.

“The severity of his crime would have earned an adult ten years in prison. That should be the starting point for what sort of punishment my client should have,” he said, according to the TT news agency.

He then detailed a number of mitigating circumstances in making the case for a lesser sentence, concluding that his client should be sentenced to between 18 and 24 months in institutional juvenile care.

According to Borgström, his client had been subjected to psychological abuse by his girlfriend and argued that the court must take that into consideration.

“My client didn’t have the capacity to control his actions. I reject the prosecutor’s motion for four years of juvenile care,” he said

The girl’s attorney, Jan Karlsson, also argued that the punishment shouldn’t be more than two years in a juvenile facility.

He said the case was complicated and argued that it wasn’t possible to say that one of the two teens was more responsible than the other.

“Both were under stress and emotional. It’s hard to say who may have affected who,” said Karlsson.

Well if they did this murder under stress then they should not have any harsh punishment. I think bank robbers, thieves, and child molesters are often misunderstood because they too are stressed but that is not recognized. So everyone, if you are under the right age and stressed, your crimes will work out for you. OMG!

I can not think of any way this sentence can be justified. I would rather go to jail for life by taking theirs if I were the parents. The Swedish justice system speaks not for the dead or bereaved!

SHAME ON THIS SENTENCE and the judge(s).
18:01 October 26, 2009 by jose_s
They lose 20 months of their "freedom" an the 15 year old girl lost lets say... 60-70+ years.... whats the judicial procedure here? excuse my ignorance but is there a petition somewhere that i can sign to propose a law change?
18:12 October 26, 2009 by Weird_X
Another 'brilliant' sentence by the swedish justice (irony because, sweden doesn't have a thing called justice).

For their crime they're even allowed to go on a long-stretched vacation in a 'juvenile facility', given all the care they could wish for while the victim lies in a cold grave. What about her parents, does anybody in your country give a bollicks?

Sweden = Failure
18:37 October 26, 2009 by Tennin
OMG! What a complete joke. I feel sorry for the girl who was murdered and her family. Sweden really needs to change their justice system. You do more time for damaging property or stealing money, but hardly any time for murder and rape.

It looks really bad on the country, it seems like they value money more than peoples lives.
18:41 October 26, 2009 by BravoTango
I concur with the other comments. 20 months for murder, premeditated murder. What a joke. When will the justice system realize that 16 year old people must be held accountable for their actions? These kind of sentences just promote more violent acts among young people.
19:22 October 26, 2009 by Beynch
Oh. Is that all one gets? I could use a 20 month escape, a vacation, with all expenses paid. Sounds like a good idea. Now all I need to do is to find a suitable victim. - Why is the defense always psycholooooogical abuuuuuse, psyciatric disooooorder and mitigating ciiiiiircumstances, could not control his aaaaaaactions? It seems to me that this pathetic vulture Borgström should serve the time alongside his cliiiiiient. It is people like him who give the Swedish law profession a bad name.
19:24 October 26, 2009 by rybo1
This is all very sad, particularly for the victim and her family. At age 16the predators knew the difference between right and wrong, between good and evil and should be judged in that light. The sentence of 20 months for taking a life of another human being is OBSCENE. It is not justice, not in the least.
19:29 October 26, 2009 by voiceofreason
For equity, let some grief-stricken member of the victims family eliminate one member each of the killers families and then claim loss of control.

He can get a slap on the wrist too but justice will be served.

However, this is my personal opinion "Vengeance is mine, says the Lord. I will repay".

I can't imagine anyone of them going through life without a guilty conscience, they will have to live with that.
19:37 October 26, 2009 by craicen
Don't you get it. To the state an individual is but a number a member of the herd they rule over. There is no such thing at justice from the state, justice is personal. Until people recognize this and return to the ancient ways of personal justice, then no justice will be served.

Now if you commit a crime against the state, then they believe in justice. Try getting caught for tax evasion or the like and even in Sweden you will get a long sentence.

Sweden needs an state within a state, an underground organization, like the Sicilians have. The Swedish state is beyond hope and lost in its utopian ideology/religion. What do you think would have happened to these poor little children if this were Sicily? The family would get justice!
19:39 October 26, 2009 by geecee61
This sentence is a joke and sends no message of deterence out to would be young killers...how can murder possibly be justified by a 20 month sentence....I'm speachless...Therese Johansson Rojo parents must be devastated losing both there young daughter along with this travesty...shameful Swedish court system.
19:40 October 26, 2009 by Kooritze
Incredible.......Is this a joke? What a pathetic justice system and I feel so sorry for the parents of the murdered girl.
19:55 October 26, 2009 by ruswe
Are you serious ? should we put him for parole after 2 weeks for a good behavior?
20:24 October 26, 2009 by Luke35711
Truly shocking!!! What a disgrace for the name of this supposedly "model" country!
20:28 October 26, 2009 by DreEstwd
Agreed with all of the comments above. It's mind-boggling that people are not in the streets protesting this sentence as well as many others that have been handed down recently. The Swedish justice system is an abomination.
20:32 October 26, 2009 by Rebel
Each of the judges in this case should have to allow their homes to be used as half-way houses for these poor little teens until they reach 21.
20:52 October 26, 2009 by Thompsuleme
My thoughts go out to the family of the late girl. There is nothing else to say, this hurts me so much as an outsider, try to imagine (which is almost unlikely) how the victims family feel...

the justice system is the Real tragedy here... really sad
20:57 October 26, 2009 by crofab
This is incomprehensible. I love Sweden and 95% of the time see Swedish society as an improvement over the country I'm from, but in this case I can't understand what is going on in the minds of the people in Sweden who are responsible for the justice system. 20 months? And in juvenile detention? Is 20 months really enough time to rehabilitate people who were willing to murder someone in cold blood? Is 20 months a deterrence to other young people contemplating murder? Is 20 months going to give any sort of closure to the family of the victim? No, no, and no!
21:08 October 26, 2009 by pengberg
Hey nneville,

[Well if they did this murder under stress then they should not have any harsh punishment. I think bank robbers, thieves, and child molesters are often misunderstood]....

I don't have words to describe how pissed YOUR statemant has made! I hope child molesters some day will not even be allowed a trial!Bank Robbers, and theives....sure. You are a horses ass.
21:32 October 26, 2009 by calebian22
Good grief! Pengberg don't be angry.

Nneville's comments were dripping with sarcasm.
23:21 October 26, 2009 by caitlinnor
With sentences like these it does seem a bit like Sweden is operating as a lawless state. Are they trying to create a vigilante? These kids won't even be 18 when they are let out. Are they going to be allowed back to the same highschool? Is the community going to through eggs (or worse) at them on their prom night? The problem with a vigilante is that often more people end up getting hurt. The rule of law is a good thing, it contributes to the stability of the country, maybe Sweden is simply looking for unrest.
23:35 October 26, 2009 by Daniel M Hynes
And I thought the U.K.'s judical system was bad. This is a joke, but not a very funny one for the victims family..
03:41 October 27, 2009 by believe
Maybe this is why Justice wears a blindfold. She then won't have to look at the grieving parents of the victim. Unfortunately, I've seen this "justice" in the states as well. Some who get their hands slapped while others pay dearly for their bad deeds. I guess it is who you know, and not how severe your crime is? My thoughts are with the victim's family.
07:17 October 27, 2009 by Svamerikansk
This sentence makes me fear my safety. Young people in Sweden can do WHATEVER they want and get away with it. No wonder there is so much vandalism, theft and battery. People say the U.S. is violent, and statistically, it probably is, but I have lived many places in the U.S. and I have never felt the fear I feel while living in Sweden. I can never let my girlfriend walk alone on the streets at night because I am worried about her getting raped. I am scared to raise my head while I walk for fear that some punk kids will beat me up. No wonder the Swedes don't look around or socialize like Americans... they are too afraid for their safety. You can't voice your opinion in this country without fear. This is ridiculous and someone needs to step up to make this society more functional and less susceptible to crazy teens who can do whatever they want because the adults are too afraid to stand up for themselves. It is like "Lord of the Flies" here in Sweden.
09:10 October 27, 2009 by DAVID T
They will be out in less than a year - they will deduct the time already served and with good behaviour they'll be out by easter.
09:27 October 27, 2009 by Dick Swinger
for so little time its not even worth taking him in, might as well just let them g. 20 months minus the time already served in remand, pitiful. This news has ruined my day.
10:51 October 27, 2009 by Freyja14
I'm sorry but @nneville.......you think CHILD MOLESTERS are misunderstood?!?!?!?!??!?! I think child molesters should be put to death. Anyone who violates a child and ruins their life is the worst kind of offender. A child molester is a child molester. Stress has nothing to do with it!!!!!!!!!!!!!!! Shame on you!
10:57 October 27, 2009 by Kooritze
@svamerikansk

Good comment mate.....and calling swedish society like Lord of the Flies hits the nail on the head there.
11:59 October 27, 2009 by vonmarie
@Freyja14

look up the meaning of sarcasm. both of you are on the same side, as am i. this "punishment" is ridiculous.
14:06 October 27, 2009 by nneville
For those that don't know sarcasim - I was refereing to something so inexplicably heinous, that means "SICK BY EVERY MORAL STANDARD!", that any crime committed could be seen as deserving a light sentence because of stress. All people who do sick crimes and get no punishment in Sweden will see this as a way to not stop them from doing even sicker things. Especially the young.

Stop being disguted by sarcasm and read thoroughly!
14:44 October 27, 2009 by EtoileBrilliant
I blame Vattenfall. Most water utilities put in trace elements of fluoride in the water. Vattenfall seems to put truck loads of apathy into the Swedish water supply.
14:46 October 27, 2009 by Beynch
One can only hope that every decent Swede acts to ensure that any politician responsible for this sordid travesty of justice gets voted out of office in 2010! Especially the Social Democrats who must be booted out, head first, at the ballot box. Defeat liberalism in 2010.
15:17 October 27, 2009 by Truth-Teller
Well at least we know the sentence when the girl's Father knocks off the boy when he gets out in 20 months. This is all starting to look a lot more fair.
15:49 October 27, 2009 by peropaco
Most Sweden could give a rats azz about the sentense handed down to these murderes. They dont even care or are probably too drunk to even noticed.
16:06 October 27, 2009 by DeepFriedTwinky
Agree to many comments above. A joke with Swedish Justice system.
17:20 October 27, 2009 by Ahlindra
Small corrections to some things said in the comments.

They will not count the time up to now as time served as they haven't been in any type of correctional facilities but in what you could call secured homes.

Neither will they be let out early for good behavior as that is not used in juvenile correction.

That is one of the reasons their sentences are so short.

And make no mistake, I find it absurdly short.

The girl hasn't even shown any signs of guilt or remorse to date.

The boy has at least admitted to what he did. Maybe, just maybe, he could be rehabilitated and some time down the line do something good with his life.

Still, shockingly low punishment for murder :(
17:37 October 27, 2009 by mkvgtired
Seriously why dont the victim's parents just off the losers when they get out? If the sentence is only 20 months for murder then why not. Oh, the court system would probably say the parents that they should have "known better".
17:51 October 27, 2009 by Luke35711
In fairness, this was picked up by DN, SvD, and Aftonbladet on first pages today. The issue gets very substantial coverage. The consensus seems that the sentence is too low, so we are actually in agreement with Swedish public opinion.
18:07 October 27, 2009 by tonycobh
Welcome to peecee Nirvana folks, where nobody is to blame for anything. Surely there must be some way they can pit responsibility for this on 'racism'? They do for almost everything else.
18:12 October 27, 2009 by "green Swede"
Well that says it all right there.if you commited this crime as an adult, all you'd get is 10 years,"so we'll start right there" as i've posted in another thread,do these f**king judges and juries have any loved ones of their own? Talk about adding insult to the ULTIMATE injury, but whats to be done?????
20:07 October 27, 2009 by hilt_m
if you are old enough to do the crime you should be old enough to do the time. they should have been tried as adults what is this bs slap on the wrist
20:18 October 27, 2009 by spy
Wow 40 posts and not a mention of immigrants - this must be a record. Surely we can blame a muslim???

But thinking about it in many Muslim countries these people would be stoned. . .
20:25 October 27, 2009 by Nina_
This sentence is a joke.... they will spend 20 months playing videogames in private rooms. I have seen a documentary about juvenile care in Sweden and they do have access to their own TV set with videogames!
01:10 October 28, 2009 by glamelixir
Can't be true... nononono I refuse to believe this.

Honestly, I am waiting for someone to tell me this is a joke.

How exactly does this make sense at all?

And regarding stress... I guess only psychopaths are not under any stress when killing so... are we going to give only 20 months to all murderers?

SPY, you made me laugh in all this tragedy, I suggest as a cultural blending we get that idea from our fellow muslims and track these kids and stone them hahaha.

Please, someone has to do something about this. There must be some prosecutor reading or some politician trying to get more votes reading these posts and realizing that society is claiming for better justice!

Once again all the strength in the world for those poor parents.
14:22 October 28, 2009 by ironman294
There is no justice in sweden. thats what happens when you have removed God for so long from schools. Thank God in America there is still some thought of God in the country.

I say that the murdered girl's father should kill the 2 when they come out of juvinile care. As soon as thos etwo get out they will probably go to a pub and celebrate. I mean seriously if those 2 would kill a girl over jealousy what would 20 months do to fix them if that can be fixed? Woe be to people in sweden!

Sverige is in trouble.

But then again sweden allowed the nazi's to cross over them to invade Norway. Least teh Norwegians put up a fight.

But then again also during the 40's and 50's the Swedes engaged in Eugenics something the nazi's also believed in. They were true darwinists that believed in gettng rid of flaws. So the Swedes like the Nazi'z sterlized undesirables and also expermented on them. They sterilized deaf people, blind, mentally retarded people, just liek CHina does. But atleast China only does it when the peeople want to get married. During those times in Sweden so many were sterilized against their will.
13:43 October 29, 2009 by flintis
!!I see there was at least one paranoid immigrant!!

The sentence is a Joke

A family member (teenager & immigrant) is under suspicion of credit card fraud, although he was coerced, he is expecting a custodial sentence of up to 2yrs.

What is the price of life?
