Holocaust survivor can keep pension: court

A Holocaust survivor living in Gothenburg in western Sweden will not have her Swedish pension cut because of compensation payments she receives from the German state, a Swedish court has ruled.

Miriam Landau, who moved to Sweden in the 1950s, has long received payments from the German state to compensate her for the time she spent living in a ghetto and concentration camp during World War II.

In the eyes of the Swedish Social Insurance Agency (Försäkringskassan), however, the Holocaust restitution payments were the equivalent of pension payments.

The agency argued that the payments Landau received for the time she spent working in the Nazi camp didn’t amount to war reparations, but rather were based on work performed in a job taken voluntarily.

As a result, the agency ordered Landau to pay back 42,942 kronor ($6,000) in Swedish pension payments.

Landau filed a suit to have the decision overturned, but an initial hearing with the Gothenburg administrative court of appeal (Kammarrätten) in November 2007 resulted in a ruling which supported the agency’s position.

But in a judgment handed down on Wednesday, Sweden’s Supreme Administrative Court (Regeringsrätten) found in favour of Landau, ruling that she had the right to keep the full amount of her Swedish pension.

In its ruling the court said that its assessment of Landau’s case was based largely on a September 2009 statement from the German social insurance agency which highlighted the “special legal character” of the Holocaust indemnity payments and stated that the payments “should not be considered as payments made through the social insurance system”.

The court rejected, however, Landau’s request that she be paid interest on the lost pension income, stating there was “no legal basis” by which interest could be paid.

Landau, who was born in Hungary in 1924, was diagnosed with double lung tuberculosis in 1945 following time in the ghetto and concentration camp.

As a result, she has been unable to work since moving to Sweden.

OH, I see that calebian22 is back if anything regarding the Jews, The Holocaust, and the theft of the Auschwitz sign is not immediately solved the way Jews want without question.

And if you do question it - as I did on a discussion thread, asking for the rule of law to run its course - you run the risk of being called an anti-semite if you persist - what I experienced when I called for the same in the theft.

I am happy about the result with the pension for Miriam Landau. In fact, I shall be writing about her when I finish the story about what really happened to the sign if the Poles really get on with it. They had finally issued a warrant for Anders Högstrom arrest - what can only go forward if the Swedes find that there is a case for him to answer.

@Tennin: How do you know? Were you there? Ever hear of something called circumstance? Each case should be investigated individually. It's up the courts to decide how our tax money is used. Obviously since she's never worked in Sweden she's cost a lot of money to a system she contributed nothing to. I am glad they tried her case even though some nutters were crying anti-semetism at the get-go.

You should see another article on what the swedes tried to start on facebook about Haiti...The swedes are dogs and their economy is going to the the dumps and Iam happy for them...It would be great if they left the EU or where thrown out or joined Russia even...LOL

They see themselves as one, they worked hand in hand during WW11.

However, the Nazis and present day Germany took the heat for the evil committed during the war, but Sweden played a major role and ended making alot of money from the distruction of lives. Need I remind you that even Norway still hates you for the role you played in transporting the Nazis to their shores to attack them.

My ex father claimed agerman pension at the same time claiming a swedish one. The thing he did was leave the money in germany and then transferred in the UK when they thought the Germans were getting to chummy withe the swedish gov't.

And he didn't go to any camp just worked their as he was a german.

All the money sweden made from selling materials to the nazi's at least some should be repaid in some way.

The sooner I get my son and we can then leave this latent nazi state, the better. Good memories but swedes live in total denial Perhaps the reason it was neutral in the war was because even the nazi's didn't want this place. Something to be proud of

It is about one 86 year old lady who has finally got what she deserves a state pension from the country that she has lived in for 50+ years and the reparation payments from the German government.

Even if she has been unable to work, (because of deteriorated health caused by "voluntary" labour) she has paid rent and MOMS on everything she has bought of the years.

I expect that her contribution to the Swedish economy over the years is greater than the pension she will get and more than the wingers posting here who think she should get nothing

I do not understand the entire "contribution to the economy" though. This country spends millions on refugees, which only contribution to the economy (historical and future) is reduction of its development.

Sweden paid millions to the Haiti victims which are not even Swedes. Sweden IS trying to help all the people that never have and never will contribute to the economy of Sweden, just because this country believes in helping those who suffer due to someone else or nature will.

What the hell is this argument of "economical contribution" when those german concentration camp swedish survivors, whom you can count on one hand, are getting some pension, which will probably be invested into their own gravestone?

She moved to Sweden WITH HER HUSBAND and HE worked and paid taxes. She now gets a widows pension of 6,000 Kr a month after the death of her husband.

She got a one-off payment of 80,00 kr under the German ZRBG law of 2002 compensating concentration camp survivors.

Like I said before, trying to debate you is like trying to explain to a child that santa claus is a fiction character. From your line of reasoning, one can reach the conclusion that you must be a 7 year old child.

To the adults in this debate, there is nothing to debate here when you start on the premise that "Voluntary" work was done by the jews in the Holocaust camp.

Sweden should try to stay clear of issues that prompt debates around the Holocaust, and WW11, because it is a reminder of how cold the Swedes were to Humanity not to talk of how they were cold to their neighbours.

Having to talk about the Holocaust and Sweden on two occasion within the same month is just too much. Firstly, the Swedish connection to steal the sign in the Holocaust camp and now Försäkringskassan saying that "voluntary" work was done by the old lady is just too much. Come to think of it, it looks like a new approach to revisionism.

I am not Anti Semitic but, like hundreds of thousands of Jews in Israel, the USA, Europe and elsewhere, I am anti Zionism, Zionism is the cause of too much terror and death. Zionism is as evil a form on nationalism - my country right or wrong as was the National Socialists of Germany.

The problem is that the moment a moderate Jew or Goy sees through the Zionists such as your self who want to perpetuate and extend the "we are being persecuted" ideology, the Zionist shout Anti Semitic. It is Forbidden by State decree to even think that the state of Israel is ever in the wrong..

Herzl, the founder of the Jewish state actually said that it was the job of Zionists to protect and strengthen the Jewish State by playing the Anti Semitic card at every chance.

Are you on medication, or just plainly illiterate?

Let me spell it out to assist. Sweden helps people who will never and have never contributed to the economy of Sweden, but just out of will to help out. and THAT IS GOOD.

Therefore any "economical contribution" of an individual, who really deserves to get a pension is irrelevant. Even if she contributed NOTHING because she was handicapped, she should have received the money anyways....

I think you are either uniformed or you are are a revisionist. Do your homework, Sweden provided services and logistics to the nazi machine to help them achieve their goals. one of such services was transporting them to the shores of Norway when they attacked that country. Sweden provided these aid to the nazi machine and made a lot of money from this while other sane nations were fighting the lunatic nazis.

Rick - the usual argument of the fresh-new nazis is that whenever they bash Jews, the Jews are always for some reason bring up Holocaust. The reason is that Holocaust started from bashing Jews first and not directly from the gas chambers.

It is funny that people who love to bash Jews, say "But you are not allowed to use the holocaust argument, because it is not fair and you always use it ". By the way - Zionism is nothing, but the belief that Jews have a right for their own country in Israel. Nothing more and nothing less.

By declaring your anti-semitism "only" as anti-Zionism (which is self defeating in discussion where a swedish Jew received reparations for Holocaust, because the discussion is about Jews and not Israel or Zionism), you still disagree that the Jews deserve a country in Israel (or Palestine, or Turkey, or Egypt, or England - depends who controlled the territory). By not presenting an alternative you are practically saying that Jews do not have a right for a country - period. That makes you anti-semite.
