Swedish woman faces charges for falsely accusing father of rape

A young Swedish woman who falsely accused her father of rape will now face charges of her own.

The father had received a five-year prison sentence in 2007 after the then 17-year-old girl told her school he had sexually assaulted her. The school in turn reported the man to the authorities.

The man was later convicted in the district court on the basis of his daughter's testimony which alleged that the sexual abuse began when she was 4-5 years old and continued until she was around 16.

The Svea Court of Appeal later overturned the man's conviction after further allegations from his daughter were proved to be unfounded.

The man spent a total of 50 days in custody and he was also ordered to pay his daughter 330,000 kronor ($45,886) in compensation. When the man was arrested his daughter and a sibling were placed in care, according to the Dagens Nyheter daily.

The daughter has now been charged with making false allegations, an offense that carries a sentence of up to two years in prison.

“I have agonized over whether or not to report my own daughter. But I hope that the case will lead to an investigation into her own mental state. And I don't want what happened to me to happen to any one else,” the father told the newspaper.

She probably stole a friend's story for she thought it might make her more popular among her peers!

Girls should learn that accusation of rape is just as serious a crime as rape itself. Perhaps they should include a chapter on this in their sexual education classes!

The sentence for false accusation should be at least the same as the sentence for the given crime! That's the only way some people will learn to stop doing that.

I would also like to know on what evidence was the first accusation based - the statement of one person? Apparently it was insufficient evidence.

It just shows that prosecutions need to be based on more than just an allegation. Some additional evidence should be needed for conviction.

Something isn't right here. First there is enough evidence to convict a man of rape, and it is then overturned because a second accusation of rape turns out to be false. Who was accused of rape the second time, the father? someone else? How does one false accusation cancel out another separate issue?

What is going on here in Sweden with all these rape cases anyway? Is the law too soft on convicted rapists? I mean 5 years for raping your daughter seems pretty light anyway.

This sad story is not coming out of nowhere. There are precedents working like a strange kind of education for that kind of girls.

I think those are the fruits of the witch hunting started by the feminists.

I m sure some feminist will say that there was a rape for sure, at least a mental one.

my problem with this and its happened in the states too. is what evidence did they lock the father up on? He clearly new he didn't do it and all she said was that he did. its a flaw in the system when so many people get locked up this way. happened to a kid in my high school. had sex with a girl...... who has had sex quite frequently at parties and the next week everyone was calling her the names....slut, hoe etc...... so of coarse she cry's rape.....to mentally convince her self that shes not these things....... 6 months into his jail time she finally comes out and says he didn't do it, that it was consensual. Always sooooo quick to just slap the cuffs on a man and label him a rapist without taking into consideration just how psychotic and crazy some women are. she has done this to her own father, i feel sorry for the guy that falls for this girl and she has a bad day, he'll be right in the clinker!!

Kenny, Well, if guys can call any girl "slut", "hoe", etc because she had "consensual" sex with them and damage her social life, It's only fair that girls call any guy who sleeps with them "rapist" and do the same damage!

Don't blame it on the girl when she lives with this kind of boys. they both need to be slapped in this case!

Your example is invalid. However, the story in the article is a true sad story. And i agree with the comment that said she should get twice his sentence. or at least the same he served.

I think she is mentally deranged woman who needs our sympathy. Through the years she might have committed many other nasty mischievous before she shouted rape. I am surprised how the parents, or even her school mates, have not noticed.

There has got to be a more severe punishment. The dad is not the only victim here. You have to factor in all of the rape victims who are too afraid of not being taken seriously to report their crime. This woman is the real rapist.

@ Deema: how can you compare calling somebody names with sending somebody to a prison? That's really not the same damage! That's total nonsense and a really desperate attempt to put the blame always on men. Furthermore she was probably called these names rather by other girls.

Well the statement says it all, and predicts future trends anymore! With all these rape cases and reports, why don't people focus on what seems to be a major driving force behind some cases?? The COMPENSATION to the victims! YEAH YOU HEARD ME RIGHT! ,000 kronor ($45,886) in compensation!!! Wowsers! Just a word from the victim and the man is fried for compensation! Yes of course with substantiating evidence! But what if she really consented? And Supposing there was no compensation, but just a jail term for rapists as in many countries, would there be so many reported or alleged rape cases? I think the system is messed up with all these greed enhancing compensations given the number of lazy girls springing up in the streets and still looking to live the same "hell paving" lives at the expense of others!

Well let us see what the Swedish police and prosecuter do with me. I have been accused of threatening someone with murder. My lawyer advised me to make a police complaint as there was very strong evidence to this false allegations, ie her lawyer, my lawyer, and four judges, plus the recorded testimony.

This was the finally straw after 9 police complaints about me and 12 attempted restraining orders. ( all of them the police have not spoken to me ). I know this as I got the list from a police station , although now they tell me I should not have recieved this copy. I have also been accussed of attempting to kidnap a 3 year old girl in Mörby while I was at work in Nacka, and assaulting an 83 year old woman in Sandviken, while I was having a BBQ in Stockholm at my house with friends from England.

Let us see if there is justice in Sweden

Uncle, I wrote that there are FEW false accusation cases...So, its a much bigger problem that around one in three women will be forced into sex or other wise will be abused in their lifetime. Anyway, its sad that these false reports affects the real victims and make it harder for them to be believed and it is a serious problem that SOME GUYS get much more worried/shocked about the few false accusation reports than about the huge amount of rape victims/ free walking rapists.

Alex Coman, are you really SURE that false accusations cases and feminism have a connection ?!

Maybe its time that MEN use common sense to avoid false accusations; Carefully meetings with women, avoid out going/drinking etc...

Saying men are at fault for false rape allegations is blaming the victim. That's the same as saying a woman is at fault for getting raped when she wears revealing clothes, walks alone at night, etc.

Or do you hold men to a higher standard - ie, in most situations (not just rape/false rape accusations), women can only be victims, and men are superior because we should have a greater capacity for controlling our actions than women. Which is it?

What an extraordinary comparison. Calling someone slut or hoe is an insult, but it does not send the victim to years of prison sentences. Calling these two "the same damage" is a very unbalanced idea.

Unfortunately, this kind of unbalanced opinions seem to drive discussion about sex offenders in many European countries, not just Sweden: "it was rape if you feel it was rape". Feminist subjectivism is actually becoming a threat to civil liberties, and the law just bends and bends.

Thank you for the clarification. Some people - women AND men - are not. Some cannot see beyond their side of the fence. I am glad you are fair-minded with respect to this tough issue.

For the record, I consider myself a men's rights advocate, but I do not consider feminism bad or the root of all men's problems. In fact, it is a noble ideology to which I subscribe, but it can be warped by some people, just as the men's rights movement and any other movement can be. I hope for true equity/equality for both genders someday soon...

Just wanted to throw that out there in case it matters.

I don't blame the daughter or the father as much as I blame a lousy judicial system -- or actually, more like a lousy defense team -- for not picking up on the opportunity to question the teen's mental state during the trial to diminish the credibility of her testimony, if she truly WAS so troubled as to blame her father of not just ONE instance of abuse, but 13 years of it! This is ridiculous. Crime accusations have become a case of "the boy who cried wolf". Feminism, Masculinism, it doesn't matter. Human rights have leveled the playing field for the benefit of ALL people, particularly women, but apparently we still clutch to medieval biases that all women are innocent damsels and all men are guilty of crimes they are accused of, so much so that a jury would convict a father based strictly off of a teen's testimony alone. (For the record, I am a female, so don't call me out for anti-feminism statements.)

They say everything happens for a reason, and hopefully this will have shed some light on the blatant weakness of swedish trial attorneys to do their job appropriately. Perhaps this will pave the way to new, more polished practices in the legal system.

I doubt looking at the mental state of the accuser is the right way forward, as this will just make genuine rapists target those who are vulnerable and likely to lie (eg. mentally ill)

What is important is to look for evidence of rape (a woman can easily make up a story after a one night stand she wasn't satisfied by, for example), which again is extremely difficult. There can be evidence of sex, but is that rape?

Maybe the only sure way out of this is for men to produce a contract of consent for the woman to sign every time he sleeps with a stranger... kills the romance a bit! But it's far better than ruining an innocent's life.

And in Britain they actually mention the accused name's in the media before the case goes to court, does that happen in Sweden? It leaves the accused open to vigilantes, whether he is innocent or not.

of "the ends justifying the means", ie does it matter that a few innocent men end up in jail if it results in less rape cases?

The reason "SOME GUYS" see this as important, is that the number of "false rape" accusations has increased over the past few years, and the "guilty until proven innocent" stance the legal system has adopted during the past 2 decades in cases of sexual assault, has made it exceedingly difficult for those who have been maliciously accused to prove their innocence.

The impact in these cases of false allegations goes beyond just ruining the life of the accused, it affects those around them.

A recent case in Australia, saw a 15 year old boy held in jail for 12 months following a false rape accusation, he was refused bail. And despite the fact that the accusers story did not make sense, that her story changed during interviews, that DNA testing proved she was a liar and that there was no corroborating evidence ie it was only her word, the case went to court. Fortunately he was found not guilty, but this cost his parents everything, they had to sell their house and go into debt to pay the legal costs, and received "nothing" in the way of compensation after the case.

Oh, and on your comment about men being more careful, in this case the only contact the accused had ever had with the accuser, was in an open public area of a busy university campus, where the false rape supposedly occurred.

I am positive there is a connection, after all which group was it that as part of their vilification campaign against men came up with such slogans as "ALL MEN ARE RAPISTS" (both false, and offensive) and the other great lie (which these days has proven to be quite laughable) in order to obtain the moral high ground "ONLY MEN RAPE".
