Man walks free after stabbing wife

A man who called the emergency services to say he had stabbed his wife twice in the chest has been cleared of any culpability after Jönköping district court ruled to drop the charges against him.

The man, who is in his forties, dialled the emergency number just after the attack in March at an apartment in the southern Swedish town.

His wife sustained life-threatening injuries but survived the attack. Her husband was arrested and charged with attempted murder.

“He wasn’t aware of what he had done,” said district court judge Nikolaj Jeric.

The results of a psychiatric evaluation showed that the man was suffering from a severe psychological disorder both at the time of the examination and the attack on his wife.

Armed with the test results, the court could have ruled to have the man placed in psychiatric care if he was found guilty of the charges against him. Instead, however, the court decided the charges should be dropped after finding that the crime lacked the element of intent outlined in the indictment.

“It’s a very unusual situation,” Jeric told public broadcaster Sveriges Radio.

“It is not legally possible for the district court to prescribe psychiatric care if he hasn’t been found guilty of a crime. In this case, the court has decided the charges should be dropped since he didn’t carry out the deed with intent,” the judge added.

Since the man has been cleared his wife will not now be entitled to any form of compensation.

In this case, the judge should be put in psychiatrict care along with the offender.

I hope she sues the state. She deserves compensation for the abuse she has suffered from the state and her husband.

All civilized countries have laws to protect the mentally ill from criminal prosecution. Those unable to form "intent", (mens rea) because of their illness, are unable to commit a crime because "intent" is an essential ingredient to most crimes.

The judge accepted the medical opinion this man was sick, and who are we to challenge him? I assume #3 above has no psychiatric qualifications, and did not hear the medical evidence. I am sure he/she will correct me if I'm wrong.

There does seem to be a defect in Swedish law, as pointed out by the judge, who in Sweden, is bound to follow the law as it stands, whether he likes it or not. That is the fault of the legislators who wrote it, not the judge who must follow it.

I agree with Kevin Harris. An individual who is not aware of his actions while he is committing a supposed offense can't be considered guilty.

But what shocks me is the fact that Swedish laws seem not to follow the principle of applying in this cases what in my country (Spain) is called "medidas de seguridad" or "security measures" (i.e., an individual who commits a supposed offense due to mental illness is properly confined and subjected to psychiatric care, during a period of time which can't last more than the time of the punish for that supposed offense).

But the judge can't be blamed for that, because he just followed the current laws.

However, he was aware enough to call emergency services immediately following the attack. This is bs.

The man is a clear threat to society. This is just plain madness to let psyciatric cases to come stroll on the same streets as the people who are unaware of his mental state This is crime, regardless of whether laws are clear enough.

I wish it would not be necessary to get judge's daughet get stabbed before she realises her mistake.

So, this man who has severe psychological disorders, and attempts to murder his wife, (accidentally) is found innocent, but is not mandated to undergo treatment?!

Is there something just a little INSANE about this ruling?

How did he know to call the emergency services?

He was SO crazy that he thought he was making that up too!!

And the judicial system here is SO crazy it believes him!!!
