I hope she sues the state. She deserves compensation for the abuse she has suffered from the state and her husband.
The judge accepted the medical opinion this man was sick, and who are we to challenge him? I assume #3 above has no psychiatric qualifications, and did not hear the medical evidence. I am sure he/she will correct me if I'm wrong.
There does seem to be a defect in Swedish law, as pointed out by the judge, who in Sweden, is bound to follow the law as it stands, whether he likes it or not. That is the fault of the legislators who wrote it, not the judge who must follow it.
But what shocks me is the fact that Swedish laws seem not to follow the principle of applying in this cases what in my country (Spain) is called "medidas de seguridad" or "security measures" (i.e., an individual who commits a supposed offense due to mental illness is properly confined and subjected to psychiatric care, during a period of time which can't last more than the time of the punish for that supposed offense).
But the judge can't be blamed for that, because he just followed the current laws.
"The results of a psychiatric evaluation showed that the man was suffering from a severe psychological disorder both at the time of the examination and the attack on his wife."
However, he was aware enough to call emergency services immediately following the attack. This is bs.
I wish it would not be necessary to get judge's daughet get stabbed before she realises her mistake.
Is there something just a little INSANE about this ruling?
