Assange in new Swedish arrest warrant appeal

WikiLeaks founder Julian Assange on Tuesday appealed to Sweden's Supreme Court to overturn a ruling he should be detained for questioning on allegations of rape, the high court said.

"We received the appeal today," Kerstin Norman, the case handler on the docket, told AFP.

The Stockholm district court ordered an arrest warrant on November 18th for Assange for questioning on "probable cause suspected of rape, sexual molestation and unlawful coercion" in Sweden in August.

The court order allowed prosecutor Marianne Ny, who had requested Assange's detention, to prepare an international arrest warrant for the 39-year-old Australian, who travels constantly and whose whereabouts are mainly kept secret.

Assange, whose whistleblower website unleashed a new storm at the weekend by beginning a massive release of classified US diplomatic cables, appealed the lower court order, but his petition was rejected by the Stockholm Appeals Court last week.

Norman said the country's highest court would first need to determine whether to hear the case at all.

"This is a so-called high-priority case, so that decision should go quickly," she said, adding she expected the ruling to come "tomorrow, the day after, but also perhaps next week."

"If no trial permit is given, the appeals court verdict will stand, but if a permit is given, we will reconsider whether the detention order was correct," she said.

Such a hearing would also likely go quickly, Norman said, adding it would take anywhere from "a few weeks to over a month, depending on the circumstances."

Assange's lawyers both in Sweden and Britain have decried prosecutor Ny's decision to seek their client's arrest simply to interrogate him, insisting he had proposed several dates and times for questioning, but had been turned down.

WikiLeaks began at the weekend slowly releasing around 250,000 sensitive US diplomatic cables, again sending shockwaves around the world after its two other mega-leaks this year involving hundreds of thousands of classified files on the US wars in Iraq and Afghanistan.

An international arrest warrant must be issued for Julian Assange of Wikileaks and he should be extradited to Sweden where he faces rape charges. The U.S. government must shut down Wikipedia immediately. This is not freedom of speech. I can't believe this hasn't been done yet, what type of Mickey Mouse operation has the U.S. government become? Obama has not even addressed the situation. Can any of you imagine this happening under the Nixon, Reagan, or George H.W. Bush (the father) administrations? In the old days Assange would have disappeared. Diplomacy is an art form and when executed correctly it can stop wars. Let me repeat diplomacy can stop wars and Assange is interfering with diplomacy among other things. Without diplomacy the only option to solve the world's problems is war. I am pretty sure that no one wants a world of full on chaos and constant war. Make an example of Assange and get him.

By the way, I'm curious what it would solve for the US Government to shutdown "wikipedia" as you suggest? And how does the government go about magically shutting down webservers that are not located on its territory?

Hey mojofat. You may not agree with Reagan or Bush's policy or what they bumbled but at least it was their own mistakes. They messed up trying to carry out their agendas. That is normal its part of governing. This is a complete outsider releasing information against the interests of the U.S. You may disagree with America's policies but honestly who cares what you think? When the Romans were in power the world hated them cuz they did messed up things to stay in power, same with the English Empire in their day. The most powerful countries have to do shady stuff (I agree with you that Iran Contra and Sandanistas was crap policy) to serve their interests. But again an outsider providing the biggest intelligence leak ever to anyone that has a computer (including enemies of the U.S. and Sweden and all democracies) is shite. Our government has hackers that can do just about anything-stayed tuned and see what happens in the next couple of weeks. Plus this guy is wanted for rape in your country, are you cool giving rapists that operate in your country amnesty? Nothing which came out of this till now, has shown anything the world didn't know! The only surprise was China's stance against N-Korea. Spying on the UN? Nothing new. The way they think about other world-leaders? Nothing new, as the rest of the world thinks exactly the same. Request to attack Iran by it's neighbours? That was easy to guess. All in all, much fuzz about nothing. Just keep walking, nothing to see here.

Assange seems to be trying to elevate himself these allegations. They're disturbing to say the least; refusing a woman's wish to protect herself against the possible spread of venereal disease. If true, it points to a classic narcissist, a man in love with his own reflection.

Steer away from his "noble" intentions; question how much he likes to watch himself on video. His leaving the CNN booth when questioned about this also points to an individual incapabable of accepting criticism.

As far as his "fearlessness", I'm waiting to see if he releases anything from the Russians and Chinese. Right now he's hitting "soft" targets, the Western Democracies. Information on Wikileaks about China and Russia come from Western Diplomats, most of it merely embarrasing but not confidential. If he's "brave", he'll release the official communiques.

If his treatment of women in Sweden an accurate assessment of his character, I'm betting he doesn't.

In this new world of terrorism, I believe that there are some secrets that we, the public, do not need to know. There are some truly evil people out there who do not adhere to any moral code and who, without batting an eyelash would kill me or you or your children just to further their twisted cause. These people are not to be treated lightly and the people who are out there fighting terrorism should be given out greatest respect.

Pfc. Manning should be tried for treason and, if found guilty, hung. Assange is no better.

Could anybody kindly inform me what process Julian Assange went through to become the world's elected saviour for truth and justice.

Nobody can as yet give a true evaluation as to what damage these leaks are going to trigger. It is guaranteed, though, that the brunt will be borne by those least able to protect themselves, the disenfranchised and the vulnerable. This will not harm the "Big Players", who at most may be a bit embarrassed at the moment, but who will resume their activities, as normal, once this news blows over.

I whole heartedly concurr with the sentiments expressed by GLO, dizzy09 and others who have the intellect and maturity to see the potential damages that these reckless publications are likely to provoke.

Anything which weakens the effectiveness of our elected governments, by consequence, puts each, and every one of us, into a more precarious position,in an already dangerous world.

There is nothing noble about this action, rather these are the twisted actions of a social inadequate, craving attention and indulging in self promotion.

No different than a juvenile messing about at a funeral, to gain kudos with the smaller kids.

btw I am worried about this world with having new definitions for freedom of speech! I mean a hundred years ago, governments were not threatened by freedom of speech as they are today, so they based their constitution or laws based on freedom of speech. Nowadays it is really a pain their somewhere! Even swedish court is not ashamed of ordering an international arrest warrant for just "questioning" the guy for rape? why making such a big scene? why not asking him to come to Sweden and answer the questions? Oh wait! wasn't he in the country when they first accused him of rape, then dropped the charges, then when he left the country (because he was denied a work visa) they charged him again?! why didn't they just "question" him first time?

I have a friend here in Sweden who has been threatened and abused and has been subject to physical injury by her ex husband (testified by swedish doctor) and the Swedish police has not yet even arrested him. not even a restraining order! I personally called the police and asked them to please ban the guy's phone number so he can't abuse or threaten my friend any more! they told me: oh we can't do that! we first should see the cellphone!

Let me see if I understand this. Assange was with two women who agreed to have sex with him, in other words a threesome. They then changed their mind. They claim that Assange wouldn't take "no" for an answer. He claims he doesn't even know the women. If the women are telling the truth, are we to believe that they had to fight off a single man? Would that be so difficult? In any case, they were not raped. The warrant for Assange is merely to have him questioned. This sounds like a tempest in a teapot.

As for the cables, leaks happen all the time. Many times, they are deliberate. In this case, the various dispatches from the embassies were embarrassing. They were not serious enough to threaten policy or cause a terrorist alert, as some commenters allege. Everyone knows that embassies are dens of spies. So what is the big deal, except that our suspicions are confirmed?

Lastly, why is Sweden suddenly the American intelligence community's best ally? First, it implements an online snooping law even more draconian than America's own. Then it gets caught up in the WikiLeaks affair. It seems an awfully unnecessary additional and dangerous burden for a small country trying to hew to a middle path in a dangerous world.

PS I am an American. I don't feel more threatened because of the WikiLeaks. I feel more vindicated in my belief that the embassies' work imperils the American people more often than it serves our interests.

I remember about 10 years back when an american man had sex with dozens of girls, some with and some without consent, whilst he had been diagnosed for HIV/AIDS. Two of the women were diagnosed as having contracted HIV. He subsequently fled the country and there were no international arrest warrant issued.

The Swedish government MUST wake up see what it's doing.......

I thought the article said that "he should be detained for questioning on allegations of rape". It's a breathtaking leap from that quote to what you wrote! Where on earth did you get the idea that rapists in Sweden might be given amnesty?

Don't you mean "anything PUBLICLY DISCLOSED which weakens …"? I would suggest that, hidden or disclosed, any elected government that promotes some of the ideology contained in these cables, exposes us to that precarious position. The only difference is that we now know about it!

As an historian with a consuming interest in world affairs, I think the cables fill in many blanks. Whenever some international event occurs I work through international reporting in an attempt to get a rounded off idea of what happened and why. (Through online newspapers and journals.)

These cables only add to our knowledge of the mindset of some of the actors - not all, of course, but diplomats and spooks inserted into an embassy are powerful figures in Foreign Affairs and policy forming.

I am not interested in the rather mild character assessments that the media have jumped on - as Hilary Clinton said that foreign leaders reassured her with "you should read what we say about you".

Finally, it is pathetic that this site has been used for character assassinations and insults, just because a poster disagrees with a post. As my grandmother used to say - "now you go and wash your mouth out with soap and water"!
