Charges against Assange 'not political': prosecutor

A Swedish prosecutor investigating the rape allegations against WikiLeaks founder Julian Assange denied speculation from one of his lawyers Sunday that the case is politically motivated.

As fresh leaks of US diplomatic cables heaped more embarrassment on Washington, one report suggested that the revelations would force a major reshuffle of their diplomatic, military and intelligence staff.

Swedish prosecutor Marianne Ny, who is handling the rape allegations in Sweden, defended the pursuit of the case in comments to AFP Sunday.

"This investigation has proceeded perfectly normally without any political pressure of any kind," prosecutor Marianne Ny said.

"It is completely independent," she added.

It was Ny who successfully applied for the Interpol Red Notice against Assange, indicating that he was wanted for questioning over the allegations of rape and sexual assault against two women in Sweden.

Earlier on Sunday, Assange's British lawyer, Mark Stephens, had expressed concern that the pursuit of Assange had "political motivations" in comments to the BBC.

"I can very clearly say no, there is nothing at all of that nature," said Ny.

Stephens, in his comments, also warned that WikiLeaks had secret material in reserve, which he likened to a "thermo-nuclear device," to be released if it needed to protect itself.

While it is not clear what this might be, WikiLeaks has already said it plans to release tens of thousands of files exposing abusive practices in US financial institutions.

WikiLeaks has been in the eye of a media and diplomatic storm since it started leaking US diplomatic cables from a collection of some 250,000 it had obtained, embarrassing and infuriating Washington.

Assange, who is believed to be in Britain, broke cover on Friday to say in an online chat that he had boosted security after receiving death threats. WikiLeaks says 831 cables have been posted to its site so far.

Among the latest revelations was one document that said Saudi Arabia was the key source of funding for radical Islamist groups, including Al-Qaeda, the Taliban, Lashkar-e-Taiba and Hamas.

Gulf states Qatar and Kuwait were also lax in pursuing locals who donated to the groups, said the cable, an assessment from US Secretary of State Hillary Clinton dated December 30th, 2009.

Austria's defence minister on Sunday expressed his annoyance at leaked US cables complaining about his government and its "lack of interest in foreign policy."

"We are waiting for clarification from the American ambassador," said a spokesman for Norbert Darabos, who said the criticism, which specifically named the minister, "does not reflect a great understanding of politics."

US news website The Daily Beast reported on Sunday that the leaks might have made it "dangerous" if not impossible for those found to have been strongly critical of corrupt or incompetent governments to do their job.

"We're going to have to pull out some of our best people...because they dared to report back the truth about the nations in which they serve," a senior US national-security official told the website.

The State Department, the Pentagon and the CIA were working on the assumption that they would be changing personnel at several US embassies and consulates in the coming months, the report said.

Meanwhile, WikiLeaks faced the prospect of a fresh attack on its financial lifelines. PayPal had already announced on Friday that it was terminating its dealings with it on the grounds that it was encouraging illegal activity.

On Sunday, the Swiss Post Office said it was checking Assange's account with its banking arm after doubts emerged over the Swiss addres he had provided.

"We have to find out if Julian Assange really does live in Geneva. In the process of checking, we did not find his name in Geneva," PostFinance spokesman Marc Andrey told AFP.

In an online editorial posted on Saturday, Assange denounced decisions by several companies to deny Wikileaks Internet or financial services.

"What we are seeing here are dangerous moves towards a digital McCarthyism. These actions, and the others like it, are not the result of a legal process, but rather, are a result of fear of falling out of favour with Washington," he wrote on the WikiLeaks site.

What a total bunch of B.S. Yeah, suddenly Sweden starts to care about rape. And they care about it enough now to actually put an intl warrant out for this guy, just to "question" him. Puhh-LEEZE! Sweden won't deport a rapist but they care enough about the crime to put out an international warrant out for someone who they want to question about rape? This whole thing is so transparent it is sickening.

Also, someone (I think Nemesis) had written about how it should now be expected for Swedish media to name and put a picture up of all rapists (in this case, suspected rapist). I agree. If Swedish media doesn't do this from now on they are proving their hypocrisy. There can't be one set of rules for Anglo people and another set for non-western immigrants.

It doesn't matter. Even if Assange is found guilty of rape in Sweden, he'll only have to do 1-2 years anyways, if that.

It is clearly a political decision , only a mere dump person doesnot agree on it . the character assicination was and is the first trick to stop freedom of speech specially when it is against the injustice and tyranny of US and its allies .

@ Ravioli: Sweden does care about rape. I am sure you will argue about a few select cases in which you (and most likely I) feel that justice was not well served. That is granted. But to make such a sarcastic and over-simplified statement, that Sweden just doesn't care, nullifies your argument. Furthermore, Sweden does deport. Earlier this year it deported 550 immigrants from Malta. So, your statement is further nullified.

@ europeman31: I am not sure what a "dump person" is, but I think you were meaning to say "dumb person." Insult aside, I ask, what proof do you have? You speak of a "character assicination," (assassination) but of what character? He has admitted to engaging in sexual activities with these two women. They claim he didn't want to use a condom, and didn't. This is a legitimate reason for the authorities to question Mr. Assange. It is very convenient for him to state that "it's all America," but he offers no evidence as to how they are supposedly doing this. For a man that has made his living airing other's dirty laundry, it's striking that he has such a difficult time with his own.

Prosecutor Ny is correct in stating that this decision is not political. Swedish authorities have worked with Interpol numerous times in the past to apprehend criminals who have fled abroad. This is no different.

Ms Ny knows her career is at risk. Perhaps that is why she avoided some of the more salient points.

Such as: why did the prosecutor break the law by announcing to the press the name of the defendant? Why were the charges dropped and then resurrected? Why was a Gothenburg prosecutor appointed instead of a Stockholm one? Why was JA told he could leave Sweden and then an arrest warrant was issued immediately after? Why has she applied for an order that JA be held in communicado, even from his own lawyers? Why has a senior Stockholm policeman said the prosecution is so discredited, the case has no chance in court? Why is a defendant charged with, what so far seems to be a minor sexual offence, on the Interpol red list next to maffia leaders, drug lords and serial killers? I think we deserve a better explanation from Ms Ny than her reassurance that everything is "perfectly normal". It is clearly and absolutely not "perfectly normal", and anyone who thinks it is, is a fool.

Of course Ms Ny does have reasonable and believable explanations why she believes these events are "perfectly normally"; she just forgot to tell us what they are. Never mind, perhaps she can tell us now, so we all feel better about things.

"An Interpol Red Notice is not an international arrest warrant. These Interpol 'Red Notices' represent only a tiny fraction of the number of red notices issued by Interpol. The persons concerned are wanted by national jurisdictions (or the International Criminal Tribunals, where appropriate) and Interpol's role is to assist the national police forces in identifying or locating those persons with a view to their arrest and extradition. Now then, I have given you information with a credible source. With regards to all of your allegations, I ask that you supply a source or valid evidence from a credible source. Not Wikipedia or a blog with an agenda, but an actual, credible source.

An explanation what the Interpol red list is always intersting, but doesn't explain why a person wanted only for questioning concerning a minor sexual offence appears on it, alongside the world's major criminals.

The other issues raised in my post #5 have been widely reported in the world's press, and particularly here at The Local. Please refer further credibility issues to the editor.

You write that the prosecutor broke the law. I've asked before for evidence that this is the case and have yet to see it. After all, the name was already made public by Expressen who had received a hot tip (as newspaper tend to do). Is there discretion on the naming of suspects allowed in this type of situation ? You write in a declaratory way so I assume that you have read the relevant law. Can you provide a relevant link (and remember no blogs) ?

Also since you're being quite the forum warrior at the moment I would also like you to back up the allegation you made against me (and repeated on a subsequent thread). You alleged that I thought that JA's innocence must be proven As evidence you cut and pasted some sentences I'd written, after having first removed several key words from the sentence. I regard this as being intellectually dishonest. Instead of going ad hominem as you did on an earlier thread can you please just provide the relevant quote in its entirety and justify your allegation. I believe it can be found at: http://www.thelocal.se/30532/20101201/ in post 17.

The above two requests are linked. You make declaratory statements and assert that people who don't follow your reasoning regarding the legal action must be fools. It is not unreasonable to request that you demonstrate your own credibility when making assertions i.e. show that they are evidence-based.

It is no 'error' that Assange is in the UK and presumably the UK extradition procedures will be followed. This, prima fiacia, suggests that at least 'reasonable evidence' must be produced to warrant extradition (as distinct from rendition).

Interesting that he is 'wanted for questioning' when it seems he has many times volunteered to meet for a QA session. (according to BBC report http://www.bbc.co.uk/news/world-europe-11921080 )

Justice should not only be done, it should be seen to be done. That is, justice is best served when all is clear. Not all is clear in this scenario and what is unclear brings the Swedish justice system into disrepute - something already done by the issue of an incorrect or inadequate warrant that had to be re-issued and by the withdrawal of this case on a prior occasion by a different (Stockholm - where the alleged offences are supposed to have occurred) prosecutor.

@HowSwedeitis,,,,,do you understand what you just posted? You just said Mx. Ny put out a worldwide notice to stop and detain Mr. Assange. She did this without an arrest warrant in her hands.

Putting out false red notices does not put Mx. Ny in the realm of judicial misconduct. It just makes the red notices a joke and ignored when they could be an effectual tool against worldwide crime.

Next I expect Mx. Ny to start using this method to attack her loud neighbors and that dog that poops in front of her door.

To any rational adult, that is political harassment in the most cheesy way. She is just a pawn and her own motive will come out in a well researched book about this matter. I'm looking forward to this massive volume.

What we know right know is Hilliary Clinton pissed someone off at a highlevel in the state department. Computers are well monitored for common worker. Only the upper level individuals and their staff can release this information to wikileaks.

If teh charges against Assange (whose recent release, I do not support) are not political, then the Swedish government needs to prosecute ever other alleged rapist in Sweden.

At present an alleged rapist in Sweden is treated by police, judges and prosecutors as the victim.

The sudden conversion of Sweden to prosecuting alleged rapists is a good thing.

I expect to read in publications names of rapists and there jail terms from now one. You can't have double standards.

I wonder what would have been the result if the 'current standards being applied today' had operated at the time of, for example, Watergate?

I am not in favour of genuine secret documents being revealed, however, it must be admitted that comments about Gadafi's Ukrainian Nurse don't quite rank as 'secret'. Unless you happen to be the tabloid newspaper that has bought them.

If anyone really needed telling that the Saudi's didn't like the Iranian gov, then the label 'secret' was way past it's 'use-by-date'.

It is time for democratic govs to re-establish trust with the electorate. It should not be for JA or sensationalist newspapers to draw this to their attention.

One organisation says she has broken with protocol (its difficult from the report to find evidence of illegality, which you allege) and has reported the case. JO-reports are made all the time. However, has she actually broken the law ? JO is yet to report. In any case, shouldn't someone be innocent until proven guilty (rather than alleged to be guilty) ? Or does that only apply to JA ? You called me a hypocrite because you falsely alleged I didn't adhere to this principle. However, by accusing the prosecutor of breaking the law when no judgement has been made either in a court or judicial inquiry, then this is precisely what you are doing.

Still on the subject of innocence until being proven guilty, I notice that you ignored my second point. You allege that I'm a hypocrite and that I think JA's innocence should be proven. To "back up" this claim you cut and pasted (and mauled) some sentences I'd written to sort of imply this, despite the full quote saying something very different. You also repeated this allegation. I am alleging that "innocent until proven guilty" holds for everyone, and not just JA. I'm also objecting to people twisting things I write and going ad hominem. There is nothing, in principle, wrong with an ad hominem remark. If, for example, someone is xxxx then its fine to state this but one must also show supporting evidence. To make ad hominem attacks and then refuse to back them up is weak.

There are inalienable rights given to each person on the earth....Some nations formed from kingdoms don't wish to observe this thought and try everyday to subvert it. By the actions of this one Swedish prosecutor - the entire Swedish legal system will be judged internationally - so she better be right. I should think it would be the journalistic scoop of the year if political motivations are proved here.

According to my own observations, and anecdotal research the only country head that hasn't had his name dragged through the mud by Wikileaks is Hugo Chavez. Is it possible that there is "selective" release of information by Assange? And he releases only that which this lefty believes will further his own leftist agenda? For noone can believe that the US would not have anything to say about this communist piece of d*gsh*t.

If any journalist, apart from JA, dares to report it. On current form that is somewhat debatable. Maybe the scoop should be given to Fox news, then we can all have a laugh :) The only thing that really seems to be 'bad' about releases to date is the embarrasment that apparently honest assesments within a diplomatic service have caused to 'the kids with their hands in the cookie jar'.

Jon Stewart had a valid point: SA funding for terrorist orgs=more military activity=more oil= bought from SA.What a roundabout!

Interesting though that one Swedish prosecutor dismisses the case and another (in a different location and at a later date) pursues the case. Does that mean that the latter is making a judgement about the professional capabilities of the former?

I've asked you on a number of occasions to justify your statement (without mauling my words) and yet you flatly ignore the request. A hint for the future - If you're to make arguments against others you need to do more than slur, a bit of substance is also useful.

Over 3 million government employees have access to this database from the State Department, including the Pentagon (from where the alleged leaker accessed these files). The reason why so many people have access is two-fold: First, none of the leaked cables are "Top Secret", which represents the most sensitive information. Secondly, the government was roundly criticized for being to stovepiped in its structure and not facilitating the sharing of information across various agencies (especially those involved with security). Hence, you have more sharing and...coincidentally enough, "transparency" at the government level...and you get some kid who thinks its his patriotic duty to blog government employee gossip. While I agree the Iraq War Logs represents worthwhile information to expose publicly, I fail to see the overarching theme of "cable gate" as it is called. The theme seems to be that people say things in private that they don't in public...hmm, well duh. There has been nothing illegal revealed, no misdeeds by the government, nothing. So really, the only purpose one can surmise is that this is intended to embarrass and, potentially, give enemies useful information in the form of strategy or strike lists.

Further, I'm still waiting for the complete sources of funding for wikileaks/JA to be made public. That seems to be the one piece of information wikileaks won't release.

Assange hasn't released anything that would cause the US government to go through the trouble of framing him. His leaks of war logs so far haven't affected policy, because what was released was mostly information people already knew. There are questions about rules of engagement in a few instances, but nobody is paying attention to that because of the scope of the leaks, and there were questions raised about rules of engagement far before WikiLeaks existed, going back to the Kosovo War. The cable leaks weren't anything astounding either, just fodder for the media to hype. Everybody knows US officials don't like Putin, that Afghani officials are corrupt, and that Mexico is dealing with gang violence. Nothing surprising.

The US government does think Assange is a problem, because his war leaks could potentially endanger soldiers, but so far there is nothing that would cause the government to worry about anything like criminal indictments, nothing worth overreacting for.

Second, if Sweden did extradite him to the US under some agreement, I don't see there being good chances for the prosecution. Espionage cases before have gone through civilian courts, not martial courts, and this particular case could be appealed to the US Supreme Court. Half the bench there is liberal, and the conservative half, which might have a negative view of Assange, is pretty keen on free speech rights and would be likely to see him in the same light as any other media outlet.

All Assange probably had to do in Sweden was show up to court, it would be his word against the womens, and they wouldn't be able to do anything but release him. If they did happen to extradite him to the US, there would be a tough road to hoe for the prosecution. But now he can be charged with a felony for evading justice.

I won't bother arguing that the case against Assange is not politically motivated, as this cannot be proven but comes down to whether or not you believe the legal system to be generally corrupt. If a prosecutor took instructions from Swedish or foreign politicians in a particular matter, that would be a very serious case of corruption indeed.

The reason that the prosecutor is based in Gothenburg is the following, however: All decisions by a local prosecutor can be appealed against. Such appeals are decided by superior prosecutors (överåklagare) at the Prosecution Authority's "prosecution development centers", located in Stockholm, Gothenburg and Malmö. Each center is responsible for certain types of crimes. The Gothenburg center handles violent crimes and sex crimes and is headed by Marianne Ny.

When the lawyer for the two alleged victims appealed the Stockholm prosecutor's decision to charge Assange only with "molestation", the case was therefore transferred to the development center in Gothenburg. As the local prosecutor's decision was overruled by Ny, she could either refer the matter to another local prosecutor in Stockholm or take charge of the case herself.

Assange has committed treason and espionage? He only exposed the American forces gunning down journalists and innocent civilians in Bagdad. Not political? Yeah sure! For some reason i have more trust in Assange than goverments. This case stinks. Where is the crime scene, who is the victim when did it happen? Questions questions questions... He hurts corrupt goverments by exposing them and now he is wanted for a 'rape' case... This is how goverments deal with 'dangerous' parias... In China and Myanmar!

In any case this is a despicable National Embarrassment. If you are going to arrest people and deprive them of their liberties, you should do that for legitimate state reasons. The notion that a man can be arrested, transported across international boundaries, and imprisoned without bail because two mystery women from a decade ago claim he didn't wear a CONDOM demonstrates the sad state of affairs for Sweden and the new one world government.

If you are going to deprive a man of his Liberties, do so on a just, legitimate and timely charge. Let the USA issue a charge for "treason" (which by the way is nonsensical, or more properly for the "Espionage Act", let a proper interpol warrant for said charge be issued. Then insist that a similar warrant be issued to the UK Guardian and Der Speigel and let legitimate legal process prevail. This is a US & UK issue, why Sweden is intervening in a bogus political assassination campaign, based on insane interpretation of sexual assault, designed to move public opinion against Assange, escapes me entirely. This sham condom/rape case is not worthy of a free society. Think about it. You deserve better governance.

Many people have a mistaken belief that Sweden is still a model of progressive Liberalism, neutral, pro peace and a bastion of free speech. For many years now Sweden has been ruled by a motley coalition of Conservatives, Royalists, Farmers and Christian interests, some of whom are advocating joining NATO, reducing Abortion rights for women and giving strong support for Israel's wars and ethnic cleansing. Carl Bildt the Swedish Foreign Minister famously supported George Bush's Iraq War and accused Russia of a Nazi style invasion of Georgia in 2008 (the facts later showed that it was Georgia, ruled by another George Bush poodle that did the invading). US ambassador to Sweden, Michael Wood wrote (as recorded in the WikiLeak logs) that even though the official Swedish line is non-alignment, Swedish participation in NATO's Partnership for Peace and role as leader of the EU's Nordic Battle Group show that the position is an untruth. How about when it allowed rendition flights by the CIA? Sweden is now a fully paid up member of the US controlled 'International Community' / Neocon alliance and has one of the most Right Wing governments in Europe. Julian Assange was badly mistaken if he thought he was going to get any help or sanctuary against US oppression there.

Apparently Swedish men live in permanent danger of being accused of rape, if rape is defined as consent intercourse without a condom! That is the official allegation asclaimed by JA's lawyer.

Some interesting commentary. If I understood correctly, the two alleged victims have the same attorney. That should ring all kinds of bells. Why? Because these two alleged victims have, as individuals, different legal interests at stake, different interpretations of events, etc., which could put the attorney in the position of having to compromise the interests of one or both.

Therefore, it is reasonable to believe that one interest is paying the attorney for this questionable arrangement. What that suggests, apart from the other irregularities, is that something shady is going on. This type of arrangement in a criminal case often indicates that someone has been coerced.
