HIV-infected man jailed for unprotected sex

Published: 25 Jan 12 12:11 CET | Print version
Online: http://www.thelocal.se/38718/20120125/

A 20-year-old man from Malmö, southern Sweden, was sentenced to eight months in prison for not telling eight women that he was infected with HIV before having sex with them.

The man, who denies committing any crimes, was convicted by the Malmö District Court of reckless endangerment (framkallande av fara för annan).

The 20-year-old has been previously brought to the attention of the Skåne region's Centre for Communicable Disease Control (Smittskydd Skåne), for neglecting his regular contact with the hospital, and for having had unprotected sex with his girlfriend for two and half years without informing her about his condition.

She reported him to the police in December, 2010. Ensuing media reports about the incident resulted in seven other women coming forward too, affirming their own sexual relations with the man.

In an interview with Sweden's TV4, the man's ex-girlfriend claimed to have been told, "No, I don't have HIV. You don't need to worry, they're just rumours."

The man has been infected with HIV since birth and had been wanted by police since July 2011 when a court ruled he should be placed in isolation.

The man turned himself in to police upon learning that TV3 planned to publish his photograph in October 2011 on the channel's "Efterlyst" ('Wanted') programme.

The convicted man will be forced to pay a total of 220,000 kronor ($32,620) to the eight women, none of whom was infected with the disease.

The alleged crimes were committed in Malmo, Tomelilla, Eslöv and Bunkeflostrand between the autumn of 2008 and the summer of 2011. Most of the victims were in their late teens at the time.

The court says the sentence is light due to the man’s young age at the time of the crimes.

I know at least one country where what he did is considered attempted murder.
13:01 January 25, 2012 by ulster1690
8 months!! What a joke!!
13:02 January 25, 2012 by nathan45
He should have been shot
13:07 January 25, 2012 by bourgeoisieboheme
8 months for giving 8 girls HIV... so basically a month per murder. Yup, seems about right in Sweden's judicial system.
13:11 January 25, 2012 by JulieLou40
Did you not read the article properly? None of them caught HIV (God knows how).
13:14 January 25, 2012 by tigger007
he should be charged with attempted murder! he lied to these women and full knowing that having this sickness can cause death! that's ATTEMPTED to me! he's lucky that he lives in here in sweden. if i was thwe local police i would still post his pic to the news,so people can beware of him!

This tragic guy has been infected since birth. Imagine the life he must lead and the psychological trauma he feels every minute of every day.

This case is the more complex for the feelings one must have for this wretched person.

Thank God the girls were not infected.
14:18 January 25, 2012 by The Who
Yes! thanks God girls weren't infected!! imagine the guy who was born with aids.. and the fact of having AIDS does not mean that he didn't have the need of sex just like every single human being... it means he should have been isolated since puberty started? I mean this was something that he couldn't avoid to happen by his own and obviously girls would not accept having sex when knowing he has AIDS.. it is definetely a tuff situation specially when young and not mature enough..
14:19 January 25, 2012 by bocale1
I understand being charged for having lied to his girlfriend and put her life at risk and for having accepted to do unprotected sex with others, knowing that this could have led to serious threats to their lives as well.

But, come on, informing occasional partners that you have HIV before having sex with them... how many would do that and still hope to have any protected sex with anybody at all? would you have protected sex with someone just met in a pub if he/she tells you that is affected by HIV?

If a person affected by HIV must inform any sexual partner about his/her disease even in case of protected sex, then I do not see any chance of sexual life at all for him/her; and the same should then be valid for hepatitis B and C (that kill every year many more people than AIDS) and a few more sexually transmittable diseases...

Would not make more sense to just underline once more that doing unprotected sex with unknown people is a risky behavior that should be avoided at any cost?

bocale1:

you are right.. it is about avoiding getting infected! not about avoiding infecting people!! just like when u drive.. u never know when someone is gonna crash you! you must drive in a defensive way not just drive safely..

Life is full of risks and dangers.. if we can not eradicate a problem or a situation then it is wiser to deal with it in a proper way.. do not blame getting infected! blame yourself for not taking precautions :)
14:35 January 25, 2012 by zooeden
It IS a god damn tragedy, I can not start to think how nervous or stressful life he is living. He is so inmature that he goes on having unprotected sex while expanding a real pandemic threat to man kind, This kind of behaviour kill by the millions...

I recomend him lethal injection. He has proven to be a monster.
15:06 January 25, 2012 by The Who
zooeden:

if u were that kid.. would you recomend yourself a lethal injection? i wonder if u were mature enough when you were 20 and I wonder if you could have been ablwe to avoid having sex.. I hope you would! ;)
15:08 January 25, 2012 by EtoileBrilliant
Even if he lied when he said "oh that's just a rumour", it beggars belief that any girl would have unprotected sex with him after that exchange. There's no smoke without fire.

You need to question the sanity of the girl who was interviewed for TV!
15:15 January 25, 2012 by jesseblu
You got to be kidding. He deserves the same sentence as premeditated murder X 8.
15:19 January 25, 2012 by HenryPollard
Butt buuutt! racial diversity is the glue that holds Sweden together!!....
15:23 January 25, 2012 by Abe L
This should indeed be treated as attempted murder and nothing else.

$32k in damages shared over 8 people? Flat out insulting and a stab in the face.
15:43 January 25, 2012 by Svensksmith
Lock him in a room with the 8 women and give them sharp knives. I believe justice would work itself out.
18:12 January 25, 2012 by TheWatchman
He should go to jail for 21 years, the maximum in Sweden I believe? Seriously, he should get LIFE (I mean 80 years). It's good that he didn't infect anyone, but that is selfishness at the most.

i just don't understand the above. so did he use a condom or what???

doesn't he have name and surname? 8 months or 8 years???

8 months? wau Socialism is the best :D

Yes, I'm quite sure he was a blonde hair blue-eyed, named Sven. NOT?!?! Keep being multicultural, Sweden!
10:40 January 26, 2012 by si
Are you blonde haired, blue-eyed and called Sven ? if not perhaps you should forfill your ideals, save the earth and eject yourself from the roof a tall building..
12:25 January 27, 2012 by seborga82
honestly, what kind of man would carry HIV since the birth. It is very obvious...Sven and Olof? You must be joking...
12:30 January 27, 2012 by caradoc
@seborga82

your ignorance and bigotry is truly astounding.

So are you suggesting that no swede can be born with HIV ?

Are you saying that only immigrants can possibly be unfortunate enough to be born with this disease?

You are a fool
12:05 January 28, 2012 by HenryPollard
@caradoc

You are a fool if you don't realise that mass immigration has caused the HIV rates to increase exponentially in a nation which had Europe's lowest HIV infection rates pre-1990s.

But hey, who cares about the introduction of deadly diseases, violence and primitive culture, when we now have so many lovely different colours of faces to look at in Malmo. Yay, it's like a Benetton ad...
12:24 January 28, 2012 by seborga82
in 20 years from now on, let caradoc's own offspring blame their forefathers for creating the world's most unsafe place...history will judge
22:17 January 28, 2012 by sureiam
takes 2 to tangle, none of the girls were infected, MICHAEL JORDAN still lives with the desease after 3 decades of infection...... GET A LIFE SWEDES there r more important things 2 make head lines than HIV positiive.....And for the guy who said that the guy was born with AIDS, lol all I can say all Swedes need to get educated with this desease as a matter of fact by reading articles "the so called guy "HIV GUY" doesnt have "aids". He is HIV, much difference between AIDS and HIV. EDUCATION is the key here! For my understanding HIV desease isnt a death sentence....... And lastly not least to u "Nathan45" who said the guy should be shot... maybe the 8girls should be shot too for being loose and reckless on sex.... they were as much responsible as the "HIV GUY" when they opened their legs in other words "sluts".........!!!!!!!!
