Accusers 'relieved' by Assange verdict: lawyer

The lawyer for the women who accused Julian Assange of sex crimes welcomed Wednesday's ruling which paves the way for the WikiLeaks founder's extradition, while a legal expert explained there is a chance the case against Assange may not proceed to trial in Sweden.

"I've always assumed that Assange would be extradited. The regulations involved are pretty simple. European Arrest Warrants aren't that complicated," lawyer Claes Borgström told the Svenska Dagbladet (SvD) newspaper.

Borgström represents the two women who alleged that Assange sexually assaulted and raped them while he was visiting Sweden in August 2010.

Assange has admitted to having sex with the women, but claims it was consensual and that the accusations are politically motived.

While Borgström welcomed the decision, he was critical at how long the UK Supreme Court took to arrive at its ruling.

"I can't understand why it's taken so long," he said.

Speaking with the AFP news agency, Borgström said he expects Assange will be extradited soon.

"The decision (that Assange can be extradited) was what we expected ...It's unfortunate that it has been delayed further, but he will ultimately be extradited," he said.

"We expect an indictment fairly soon after he gets here, maybe within a month," Borgstroem said, adding it "could be during the summer."

Borgström has yet to discuss Wednesday's ruling with his clients, but told SvD he believes they are relieved.

"They wish to see him held responsible for what he did. Anything else would have been horrible," he told SvD.

Meanwhile, a legal expert hinted that, even once Assange is extradited to Sweden, it's possible that his case might not proceed to trial.

Speaking with The Local ahead of the verdict, Chistopher Wong, a legal scholar at Lund University said that it would be hard to imagine a scenario whereby Assange didn't end up in Sweden following the rejection of his appeal.

"This is the final decision in the legal process and the UK authorities will have no choice but to surrender him to Sweden," said Wong.

Once in Sweden, Assange would likely be held in some sort of restricted custody, according to Wong.

"There will probably be restrictions on his movements, but he won't necessarily be held in a jail cell," he said.

Once Assange is back in Sweden, prosecutors can then continue their investigation into the alleged sex crimes of which Assange stands accused.

In a statement issued following the ruling, the Swedish Prosecution Authority (Åklagarmyndigheten) said that the UK court's decision meant that "Julian Assange will be surrendered to Sweden within 10 days after a legally binding judgment".

However, Director of Public Prosecution Marianne Ny, who is leading the Assange probe, isn't planning to make any public comments about the case until an eventual detention hearing in Sweden, the agency added.

According to Wong, prosecutors will likely interview Assange in order to get his version of events from the August 2010 encounter which prompted the rape accusations.

Wong explained that, while remote, there is indeed a possibility that prosecutors could drop the case altogether after speaking with Assange.

"Most of the forensic evidence has already been gathered and prosecutors believe they have a strong case and enough evidence for a conviction," he said.

"But it all depends on what Assange tells them. It is possible that he may offer up an explanation for what happened that makes the prosecutor rethink how strong a case she has. If that's the case, then it would be her duty to not bring the case to trial."

Many Assange supporters have questioned why prosecutors in Sweden have pursued Assange so vigorously in the absence of formal criminal charges.

But Wong explained that the criticism of the Swedish criminal justice system is unfounded and stems primarily from a simple "misunderstanding" in terminology.

"There is no formal indictment, but he is a criminal suspect and has been informed of the suspicions against him," said Wong.

"If the same thing had happened in England, he would have been formally charged at that point and then prosecutors would have continued their investigation. But in Sweden they do things differently."

Thus according to Wong, critics' anger over efforts to bring Assange back to Sweden to face questioning without having been formally charged is somewhat misdirected and an "emotional reaction" to the different terminology and legal processes.

"People are simply reacting to the term, I think. Just because he's not been charged doesn't mean he's not a criminal suspect and there is evidence against him," he said.

"I can't understand why it's taken so long," said. Mr Borgstrom. Let me help you out here: some reasons why its "taken so long" are because:

1) Sweden has the highest proportion of 'right to fair trial' cases (article 6.1 of the European Court of Human Rights) brought to the court

2) Also the highest number of adverse rulings

3) Likelihood of, once extradited, Assange would be detained in solitary confinement indefinitely - pending charges/trial

4) Political interference in the Swedish judicial system

Face up to it, Mr Borgstrom, and ALL Swedes: your legal system is seen as pretty dodgy.

I'm not saying this guy Assange has done nothing wrong - only that there are very disquieting things about the whole affair

@Tamm - Well, no need to add anything, that about sums it up. I too thought the statement "why it's taken so long" was completely off kilter and completely ignorant regardless of what side you're on.

The best comments though are halfway down the page where they took people's pictures and asked them about something they pretty much didn't know ANYTHING about.

I believe one gentleman stated that he thought it was definitely wrong that a potential criminal has been sent here. LOL.

Let me see if this misunderstanding person now understands. So in Sweden, if the prosecutor is thinking about charging you, but hasn't got around to it, you are considered guilty until proven in a court innocent? Wow does that sound like a legal system that is ripe for abuse.

Well actually, I guess if there is consentual sex in Sweden and someone feels bad about it the next morning one of the partners should be tracked down across the face of the earth and treated as a rapist, especially, if they are a high profile individual who has embarrised lots of governments.

This is far more about political payback to the publication of embarrising national documents than it is about justice. History will be the final judge, not some kangaroo court system in Sweden.

assange had sexual relations with a woman who INVITED HIM TO HIS APARTMENT.

i'm not saying he did nothing wrong but sending out a european arrest warrant and having a case drag on for 1.5 years is hardly normal protocol.

in fact, its NEVER been done before. its a political thing at this point which is so wrong on so many levels.

#9: Ass-ange doesn't need to have formal charges brought against him for an E.A.W. to be issued, you nitwit. The Scotland Yard issued him the warrant when it was found to be valid by British legal authorities, there's no question about it.

If I invite you to my house, does that give you the legal right to rape me? Hint: it does not, at least not in the civilised part of the world. Your reasoning leads me to believe that you're both four years old and a misogynist.

The case dragging on for over a year is thanks to Ass-ange himself. He could have manned up and faced the allegations long ago if he wasn't such a gutless coward (but then again, all rapists are gutless cowards).

This case has hardy followed any sort of procedure. But you obviously have only been watching the tabloids. Read the case files then get back to us.....

i too hate rapists and they should not be kept alive IMO but this case is not about 'rape' in the usual context.

its based on a technicality.

its like saying 'lightly pushing' someone is technically an assault. is scotland yard going to approve a arrest warrant for that too? i highly doubt it.

if the woman had said he violently beat her, raped her etc etc then sure, go get him and throw him in a cell for 50 years. but its not like that at all. two people went home, he forgot or intentionally didn't put on a rubber. i'm not saying its ok, BUT its a far cry from what the term 'rape' generally means and hardly constitutes the need for a frikin' european arrest warrant.

everyone knows this case is not about the accusations, its all about the whole wiki leaks thing.

and sure, assange could have gone back to sweden to answer some questions but his main fear is being taken back to the USA.

and in the same thinking, the swedish police could have called, web cammed or even flown and personally asked their questions and it would have all been over and done with.

Swedish police and prosecutors can't act as legal authorities in Britain, it's common legal praxis for the suspect to be questioned in the country where the crime was committed.

Another *brilliant* idea: let's conduct Assange's trial on the internet instead, with a jury consisting of TL readers. That way we can be sure that the trial can be based on rumour and counterrumour, that the defense and the prosecution spend more time insulting each other than trying to prove their points, and that the general public can enjoy some vicious mudslinging and deliberate obfuscation. Maybe we can run the verdict Endemol-style, by SMS voting?

That's an opinion piece, based on information that has of yet not proven to be fact.

The facts will come put in a court of law if he is charged.

If the evidence is a weak as you claim, no prosecutor worth their salt would waste the time and money of the courts, or risk their reputation of their peers and basically look like a jackaxx if he goes ahead with insufficient evidence.

And Assange knows damn well that would be the case.

As far as i'm concerned, his going to this this extent to not show up and face his accusers raises a hell of a lot of questions as to his motives or innocence.

I have have been following this case very closely because it is of such importance to the whole world. Explanations have been made here that Sweden does things differently but that simply raises the question as to why the UK should extradite to a country that doesn't follow the same rules of justice as other nations. From the very beginning of this matter when the women approached the police not wishing to proffer charges but wondering if they had a possibility of doing so. They were not aware that they had been sexually assaulted until a lawyer told them so. How's that for being upset and feeling abused? They didn't know it! Don't forget that they had invited him into their beds. Regardless the Swedish authorities have a right to question him about such charges even though the first prosecutor on the matter had dismissed them for obvious reasons. Mr. Assange was also allowed to exit the country to go to England in the first place. So what happens to him after the Swedish "justice" department finally agrees that he did nothing wrong? The main question here is whether or not the Swedish government has conspired with the US government to extradite him to the US to be thrown into their corrupt and politicized judicial system. I can tell you with all sincerity that if this occurs the Swedish people will suffer the consequences of a worldwide boycott of Swedish goods and services from ABBA to Volvo.

Assange is INNOCENT until proven the opposite. Wake up people. The swedish court system is filled with crooked judges who lie, commit fraud, falsify documents, discriminate, take bribes, allow defendants to commit perjury and are an embarrassment to honesty and the rule of law. It would be wise if swedish women stop flaunting their promiscuity.

Now you're arguing against yourself. I wrote a few posts back that the .PDF is on the very same page you linked to, you know the page you assume to be words of absolute truth. I have actually read transcripts of the Ass-ange police hearing and nothing in them contradicts anything that I've stated. Nothing.

If a man and woman do not wish the man to wear a condom, then must he get a notarized legal document to prove her consent was authentic?

What other forms of birth control are permissible?

Aren't woman and men to be considered as rational human beings that are responsible for their own bodies and what goes into them?

I mean, what kind of woman wouldn't take birth control matters into her own hands since she must ultimately bear the brunt of an unwanted pregnancy? Physics and chemistry have firmly placed the burden of responsibility over a woman body into her own hands, why is the man held responsible for the decision of the woman to allow his penis inside of her?

All reports seem to indicate sex was consensual.

Assange is guilty of nothing but trusting his host Anna. Oh, and I guess he is also guilty of having a natural desire to share a bed with beautiful woman that want him. Did this woman Anna believe Assange was now her property simply because he slept with her? What business is it of hers whom he decides to sleep with?

Yes, the whole affair stinks to high heaven. There are several indications that the US is ready to prosecute him if they can get their hands on him. I personally think the organization he founded - Wikileaks, has done a great service for humanity. For once, a journalistic enterprise that offers the unvarnished truth of the conduct and corruption within our governments - a far cry from the continuous propaganda we experience in the US, It is easy for me to imagine how much the cowardly lowlifes in governments all around the world loath Assange and would seek to make an example of him.
