UK court refuses to reopen Assange appeal

Britain's Supreme Court said on Thursday it has rejected an application by WikiLeaks founder Julian Assange to reopen his appeal against extradition to Sweden.

"The Supreme Court of the United Kingdom has dismissed the application made by Ms Dinah Rose QC, counsel for Mr Julian Assange, seeking to reopen their appeal," the court said in a statement.

Seven Supreme Court justices unanimously dismissed the move by Assange's lawyers as being "without merit".

The court added that the 40-year-old Australian behind the whistleblowing website could not be extradited for at least two weeks.

"In addition, the Court has ordered that... the required period for extradition shall not commence until the 14th day after today," it said.

The ruling means that Assange has exhausted all of the legal options available to him within the UK judicial system in his efforts to avoid extradition to Sweden.

Attorney Claes Borgström, who represents the women who have accused Assange of sexual assault and rape said there is now little recourse left for the WikiLeaks founder.

"Well, that's it then. Assange has talked about the European Court of Human rights, and he has every right to do so, but it's not going to affect the carrying out of the extradition," he told the TT news agency when informed of the UK court's decision on Thursday.

Now that the decision to extradite Assange has come into force in the UK, Swedish police have ten days to bring him to Sweden so he can face questioning from the Swedish prosecutor investigating the sex crime accusations against him.

"Within four days of his arrival, he'll be put before a remand judge," Karin Rosander, a spokesperson with the Swedish Prosecution Authority (Riksåklagaren) told TT.

The court's decision comes in response to a highly unusual move in which Assange's lawyers asked the court to re-open his appeal.

Last month, the court rejected Assange's last-ditch effort to avoid extradition to Sweden, where he is wanted for questioning about allegations of rape and sexual assault.

The court, Britain's highest, handed down its initial dismissal in the 18-month legal marathon after rejecting Assange's argument that the Swedish prosecutor who issued the arrest warrant for him was not entitled to do so.

Assange has said previously he is prepared to take his case to the European Court of Human Rights, considered to be the final venue in which he could appeal of lower British court's decision paving the way for his extradition to Sweden.

Give it up Assange........go to Sweden, be found innocent and then you'll be free to go anywhere apart from the USA. The are so many strange things going on with this case and I'm not sure why he could not have been interviewed in the UK by the Swedish police. He hasn't been charged and that in my mind would be the only reason to extradite him.

If Sweden do extradite him to the USA, the whole credibility of thir legal system and politics will be called into question. The perception of Sweden extenally is quite positive in my opinion where fairness and equality is upheld by policies etc. So extradition to the USA would show a new light to Sweden.

Theoretically, the USA could file charges in the USA -AFTER- he goes to Sweden. So it would become a new case. Then Sweden would have to extradite. It just is procedure, no matter what Sweden currently plans, it then is USA choice.

Legally not much Sweden could do about it.

Precisely why his lawyers do not want him here even though he has no real formal charge, only an order to be 'questioned' - many seem to be puzzled as to why he is even scared to come if the charges are frivolous.

A guy who cut his activist and anarchist teeth in hacking can quite easily find charges brought up to him, especially under the new laws recently passed about cyber security.

@foxpur are you serious? So you think that USA decide what Sweden has to do? If USA would like to have Assange it would be a whole process including the UK. Please relax. Just because it's the USA doesn't mean that they have the right to extradite people from other countries.

If e does go to trial in Sweden he can take no heat from the fact that he will not receive a trial by a jury of his peers, merely by a panel of "lay people" who just happen to be chosen from the ranks of political parties.

Can anyone please explain how this is not a corrupt system, similar to that used in many soviet and fascist dictatorships, to ensure that the state is able to control those it finds inconvenient?

Foxpur do you have any idea how often the US refuses extradition? Let's just say whenever it is politically advantageous to do so. So why do you deny Sweden the same right to say no? If it's sauce for the gander it is also sauce for the goose.

Its very weird case, Everyone know that Sweden does not have the moral and ethic sense compered with UK, the justice system is not like you have in Uk, where government cannot even have anything to influence over the courts , USA , are behind the whole case , and the Sweden governments like always are working as proxy plat form .

My advise to the human right groups is to speak out about Swedish breaching international low when it comes working on behalf of US's CIA, like the terrorist scandal couple of years ago , and know they volunteer to make up a case for this gentlemen,
