First Swede charged in FTP file sharing case

A 31-year-old man was formally charged on Wednesday for uploading 25 films onto the internet using File Transfer Protocol, making him the first person charged in Sweden for using FTP to share copyrighted works.

The man, working as part of a file sharing network, uploaded the films from his home in Gävle, eastern Sweden using FTP – meaning that files were transferred directly from one host to another.

“It’s the first prosecution for this technique under the new legislation. But there will be more,” said Fredrik Ingblad, a prosecutor specializing in file sharingcrimes, to the TT news agency.

Ingblad describes the FTP file sharing network as “elite file sharers” – the inner circle of people who make files available to the larger public.

According to the charges, the 31-year-old man had a server at his home that was linked to others in the network and which was used to distribute the 25 films to other users.

According to the indictment, the man is suspected of violating copyright laws and assisted in the violation of copyright laws.

In previous cases of a similar nature in Sweden, suspected file sharers have been charged mostly for sharing material via the use of BitTorrent, a technique which allows users to upload and download at the same time, in small bits from many different users.

FTP, by contrast, allows host-to-host sharing.

Even though authorities are cracking down on file sharing, investigations show that many people in Sweden continue to share copyrighted material online.

I wonder how they will be able to actually get him convicted for distributing files that could be considerd to fall under the copyright laws. I hope that this person that are accused of being part of an "elite" network that understands that its not all about money. Sweden aint in a state where the goverment need to borrow more money to be able to keep their marxism projects runing. I feel that tjos will however cost alot of money as they dont know if he wanted others to use his server, if someone conect to my server ,where I store my digital copys of movies so I can stream them to some other computer I own, should I also be accused for a copyright crime when someone who dont know the law(s) decide to download them? The police should try to stop crimes that the swedish people befefit the most from. I just stop here and if anyone at FRA or the police read this I sure hope that you are a tool for the goverment.

They used FTP. Really? That's like reporting someone who robbed a bank got to the bank by driving a car. Big deal.

They never talked about how he was caught. FTP goes to one place. So how did anyone outside their group know? How did the outsider get the password to the server. Sounds like more laws were broken to protect a DVD copyright than the infringement itself.

Ahh, I'd care more if I could even get an Internet connection to my house - other than a 3G dongle.

I think I know what kind of FTP servers they're talking about, some years ago I knew a guy that was in one of the release groups. Those are the first servers where new rips of music albums appear, same for music shows etc. Some people from record labels also have access to those FTP servers and sometimes even leak unreleased stuff there, which is why some albums are on the Internet before they hit the stores.

From those FTP servers they spread to peer-to-peer networks. So thelocal for once is reporting it accurately by calling the "elite" of file sharers.

if it was host to host how did they find out?

and yeah great sweden crack down on file sharers they are worst than rapists and child molesters , and probably will get a higher sentence too.

If only they could call all criminals file sharers and deal with them instead of some fat loser in his basement

If this story is correct ....he used FTP and the server is in his home then he is completely innocent and who ever is pressing charges has broken his privacy and should be charged big time, as that is his private network and this activity is perfectly ok !

other wise anyone of the millions of people that have a media network in their homes is in big trouble especially Microsoft as it is their idea!

if the server is elsewhere then they have a case!

also if others download fro that server and are not using "anonymous" user then the issue is still hazy ...as it could still be classed personal use!
