This is an agreement between The Local Europe AB ('The Local') and users of the blog service on thelocal.se ('the Blogger').
The Local allows the Blogger to run blogs on thelocal.se. The Blogger is provided with a website address, server space and blogging tools. The Blogger is also able to activate blog comments.
This user agreement takes effect from the point at which the Blogger creates a blog account on thelocal.se.
The Local undertakes, subject to the limitations laid out below, to provide the Blogger with a blog with a URL, server space, access to blogging tools and a comment function. The blog will have a format, typeface etc decided by The Local, although decisions over certain elements of the appearance may, at The Local's discretion, be made by the User.
The Blogger agrees that The Local, including its subsidiaries and any company that may at some point in the future acquire The Local, may process personal information supplied by the Blogger. The details will be used for the administration of The Local's blog service. The Local will treat the personal details in accordance with the Swedish Personal Data Act 1998 (Personuppgiftslagen - SFS 1998:204). The Local will further undertake not to divulge the name of the Blogger if he or she has not chosen to divulge it on the blog. The Local undertakes not to spread personal details to third parties unless required to do so by law.
Only the Blogger may publish on the blog. It is not permitted for a third party to publish on the blog. By handing over login details to a third party and allowing the third party to publish material on the blog, the Blogger will be considered to have broken the terms of this agreement.
The Local reserves the right to temporarily and without warning close down the blog service for maintenance or other technical work. The Local's blogs are made available without guarantees and with reservation for any technical faults or disruption in the service.
The Local accepts no liability for injury or loss related to use of The Local's blogs or to the withdrawal of The Local's blog service.
The Local does not pay Bloggers for material published on The Local's blogs.
The Local does not vet the content of blogs prior to publication. The Blogger is responsible for ensuring that the content of the blog does not:
The Local reserves the right to close the Blogger's account, remove the Blogger's blog, remove individual blog posts or individual comments if the material falls into any of the categories named in paragraph 7 above, or if the material is in any other way judged by The Local to be inappropriate.
The Local shall not be held liable by the Blogger for any costs deriving from demands from a third party relating to the content of the Blogger's blog, including but not limited to costs related to violation of intellectual property rights, unauthorised use of commercially confidential information, breaches of the Swedish Marketing Act (Marknadsföringslagen - SFS 1995:450), the Swedish Personal Data Act 1998 (Personuppgiftslagen) or other applicable laws.
The Local is entitled to display advertisements on and around all blogs. Advertisements may be in the form of banners or any other form of advertisement used by internet publications. The User does not have the right to decide which advertisements will be displayed nor how or where on the page they are displayed. The User does not have the right to publish his or her own graphic advertisements within or around the blog.
The Local may, in the course of marketing The Local's blogs, publish material from The Local's blogs in other media, either in Sweden or abroad, without providing compensation to the Blogger. The material may be presented either in edited form or in its entirety. The Local may also, for the same purpose, translate content from the blogs.
The Local may at any time and without explanation remove the Blog. The Local shall endeavour, where circumstances allow, to give the Blogger one month's notice of removal of the blog, except in circumstances where the blog contravenes The Local's terms and conditions.
The Blogger undertakes to update the Blog regularly. If the Blog is not updated for a period of more than a month, The Local may remove the Blog.
The Local has the right to without notice change these terms and conditions. Any changes to the terms and conditions will be posted on the blog section of The Local's website.
This agreement shall governed by Swedish law.
Disputes arising from this agreement shall be tried by a Swedish court, with the Stockholm District Court as the court of first instance.
