How to cancel a "Power of Attorney" formIs it possible? |

Hey everyone,
Last year I have provided someone a signed copy of the "Power of Attorney" form (attached.) so he can act on behalf of my company if required. Now I want to relieve him from his rights so he can not speak, act or sign anything on behalf of my company, Is this possible without asking him to hand over the signed document to me? Could you just not ask hand them a revocation notice and ask them to give you back the original power of attorney?
Otherwise this is a very problematic situation as you gave unlimited and indefinite rights over to a third party. Perhaps close the company and open a new one ? ~~~PDX~~~ |

While I am not a legal eagle the example document that you posted does look rather anemic and not like any of the "Power of Attorney" agreements that I have been involved with over the years. Perhaps the registered and licensed attorney that you utilized to establish the original business relationship can advise you. I believe that I will be in the opposite situation as one of the "Power of Attorney" agreements that I have entered into will expire according to the terms of "Power of Attorney" agreement which is fairly regular practice in my experience. |

Are you sure that dropping the company and opening a new one will fix the issue?
the company is not activated yet and I'm glad that I figured out about his problem in this stage. |

Once the company is gone, any authorization related to it will be useless. In that sense closing the company may be the most straightforward option here.
In future, sign Power of Attorney documents for a specific purpose only, even if you have to do it every day. I fill in 10-20 of those a year for a variety of issues. The most important ones you will also want to have signed by a witness. An unlimited and indefinite Power of Attorney I would only sign on a death row or a euthanasia clinic. ~~~PDX~~~ |

1.The bad news.
A POA should always include a clause enabling it to be revoked at any time. In addition they should only be given for a 12 months period. 2. The good news. Swedish law does not recognise POAs per se and will always refer to board members for responsibility. I know this because I produced two this week for an international company registered here in Sweden. The POAs are used merely for visibility and comfort. |
