Residence permits of those moved from Sweden

Will it be cancelled?

Hi,

Let me explain my situation. I'm working in Sweden and me and my wife got a residence permit until 1st Dec 2013. Unfortunately it didn't work out with continuing the education here so she went back to my country to finish her study. It will take her 2 years to finish it and I wonder what will happen with the residence permit. Will it be cancelled? We were planning that she comes to Sweden next year during the summer vacations but this question bothers me.

Both cases are actually OK but not knowing for sure is bothering me a lot. In case the permit will be cancelled, I could just send her an invitation and she could come to visit me with a short term visa. Else, she could just come to Sweden with no problem.

I was told by some of my friends that Migrationsverket has no time or resources to track those with permits and they won't bother about checking if my wife has left Sweden and cancelling her permit. Yet I'm still not sure. I wonder if someone had the same experience before.

No, her residence permit can not be cancelled as long as she is dependent on you and you live in sweden and work. Ask her to visit you couple of months before her residence permit is expired and get it renewed here in sweden. But, at the time when applying for permanent residence or citizenship, the time (for example 1 year) she has been away from sweden, will not be counted towards permanent residence or citizenship, so she'll have to wait for same time that she spent out of sweden. When you apply for citizenship, they can find all this information from your passport that when and how long you were away from sweden. And if you provide them wrong information and IF case officer is picky, you can be in trouble...so don't take any risk of playing with migrationsverket.

Thanks for your reply. As for applying for renewal, I don't really think it makes sense as the process might take much longer than couple of months. I'm waiting myself for 4 months for a work permit and still they say they have no clue when I get it. Not sure though if my wife's application will be categorized in some other way which will make it possible for her to get it in couple of months as you say.

Though, she will be visiting me next summer which is at least 4 months before the expiration date so we will surely give it a try.

As for the permanent residence, that is not a problem as we are planning to live in Sweden for next 7 years at least. So she will have her 4 years after she comes back for sure. And of course I won't provide any false information to Migrationsverket.
