Im not sure about your status as a tax resident, but sales of a property in sweden that are used to fund another property within the EU CANNOT be taxed. Sweden has already been taken to EU court about this,in that they are trying/have been imposing an illegal tax which does not allow the free movement of the persons assetts within the EU.
They cannot charge you on the gain, if any profit, if those funds are to be used to purchase a property of equal or more expense than the one sold. People suggest Kronofogden as a means to get people to comply when in reality, too many Swedes in offices have no idea of what they are supposed to be enforcing,as most of them do not even understand the current laws. Please give reference to which case You are refering to with regards illegal tax? That would be interesting to see. Sweden has been taken to the European Court with regards Uppskov, which is the deferral of taxes, but this was not with regards it being illegal, but as You will find with most cases ... European Freedom of Movement People/Goods can only be challenged when it is descrimination with respect Swedish Citizens treated different from other EU Citizens. As said, it would be interesting to see what cases You are refering to, from what I see ... Tax on profit from property buy-sell in Sweden does not depend upon whether You are a Swedish citizen/resident or not, it applies to all. And it requires that the property be the main dwelling to allow deferral of taxes when making an additional purchase in any EU country according to Swedish tax rules. EU does not decide over the national details, they are focussed on making sure that all EU Citizens are treated equal within that country. |
