What is the position regarding construction of a Veranda that was undertaken without planning permission - is it possible to obtain this retrospectively from the Kommun?
Position is that a small veranda/porch was removed and replaced with a larger veranad without planning permission. With speaking directly to the Kommun, I was wondering if retorspective planning permission is possible to obtain, providing of course, that the newly constructed veranda meets planning requirements? |

It is possible, but it very much depends upon both your municipality and your attitude in dealing with them. I am not saying grovel, grovel, but a pretty humble approach with apologies might well be helpful. With some councils there is no leniency, they can well and truly 'go by the book' with no leniency, and others a pretty forgiving. There is no knowing - until you come up against them. At worst, they can make you revert to the original size, at best . . . . . .

If it's an enclosed veranda it's best to apply for planning permission. I had the exact same problem, I built an enclosed veranda and thought it didn't need planning permission. However, the kommun were completely relaxed about it. I can imagine a bitter British government worker being a lot colder about it being faced with the same situation, given the same laws. But from my experience, I don't think that it would be a major problem here. Of course, it may depend on locality, so if i had to do it over, I'd rather get the permission!

if varies from place to place, if it's an extension to an existing building, not of greater scale or proportion than the original, many kommunes aren't bothered at all. But, better to leave nothing to chance.

You need to contact the kommun and find out what is required in your area - some need planning permission - others don't it willl depend on
- size - height off the ground - area - is there a city/town plan in effekt - surroundings - does it fit in? - is it an area of historical/natural importance etc etc Best to find out ... if it is illegal you might be required to demolish it |

Thanks for the responses.
To clarify we removed a 'jerry built' veranda and replaced it with a larger (+25%) veranda. It's not glazed or meant to be glazed and has a roof covering 2/3 of the decking. I have learnt that retrospective planning approval is possible, but that it is also possible that they (the Kommun that is) may require some modifications to be made (if for example the new veranda does not accord with the town plan or local character). The last resort appears to be demolition which seems to be reserved for extreme cases. There is also a 10 year limitation rule, which means that after 10 years the Kommun cannot impose any punishments (fine or demolition). |
