Resident Permit or Right of Residence

Hello,

I am British citizen and working full time in Sweden. My husband is Swedish. Do I still need resident permit?
My understanding is only right of residence needed. But last week the passport control in Arlanda airport told me that I need to have resident permit after 3 months. Hence to seek advise here. I can't get connected to Swedish Migration Board.

as an EU migrant worker, you have to register that you are in Sweden within 3 months of your arrival. There is a form, you can fill out and post. Just search online, the form is in English, or pop down to their offices.

They may have been imprecise in their terminology. To spend more than 90 days in another EEA country, you must register your right of residence (uppehållsrätt in Swedish). You have to do this under one of four conditions:

- Work
- Self-employed
- Study
- Person of sufficient means

I assume, if you are working full time, you have done this? If not, you are supposed to. If you have, the border guard is wrong, though if you mentioned you are in Sweden and married to a Swede, he might have assumed you needed a residence permit as a family member and had not exercised your treaty rights.

Alternatively, you can receive a permit as the relative of a Swedish citizen. This procedure is not covered by the EEA treaty, so there is some more admin overhead: http://www.migrationsverket.se/info/470_en.html The upside is that you get faster access to citizenship and (I believe, not sure) access to some benefits. In the past, this has been the route recommended by various localers as worth the time and effort if you fulfil the requirements.

Thanks for the response.

All the passport control officer said was there is some kind of stamp missing on my passport and I should apply that after 3 months in Sweden. I suppose that is something to do with resident permit.

Yes, I have applied right of residence and had a letter acknowledge that.

You can phone Migrationsverket to make sure, but that sounds like all you need to me...
