I want ask as if someone knows how and where to report labor laws violations from an employer. I am writing below as to why I seek this, as may be after reading this someone would be able to advice more case specifically. I am a student but managing a part time job as well to afford my expenses here. Just recently I came to know that the rate employer is giving us per hour (95 SEK/hr for both daytime and night time)is not as per labor laws is Sweden. Further we are told that our tex is being paid we have not been given any proof that the Tex has gone to appropriate authority, as we are just told verbally. I felt it my responsibility to ask him directly at first and if he would not avoid such practices to report this to some competent authority. When I along with some other employees just inquired about this, he became harsh with us. And due to the same reason he has not paid us the salary for April. He used to practice this, that is delayed salary, but it has never gone beyond 25th of month. However this time it is almost 30th and we have not been paid. I wanted to report this to some appropriate state authority. When I approached the Skateverket they referred me to police, and when I went to a police station they asked me that Skateverket or lawyer can handle this. I am confused now that is there no department where we can report these violations. I do not want to hire a lawyer as it would cost me many times more than my salary. I am so disturbed that I just want to take this month salary and stop working for him any more. Thank you in advance for help. Regards |

I can't help with advice about how to report your employer, but I do think you should leave there as soon as you can. It sounds like a bad situation. Hopefully someone else on here can offer more practical advice.

1. There is no law in sweden with regards minimum wages. Your employer could have paid 50Kr per hour. Minimum wages are normally part of Union agreements, which I guess there is none here?
2. Police will not get involved. By not paying You the employer has not commited any criminal offence. You need to either, contact a lawyer, or ... Submit a claim via Kronofogden for the outstanding amount of pay you have not received. It will cost you a few hundred SEK to do so, but they will then chase him for it. Note: He can contest the claim, and it will be up to You to prove he owes the money, Employment contract ? (bet you didnt get one of those either?) 3. Not paid taxes. This You can report to Skatteverket, they would indeed be interested. You can even ask Skatteverket for tax info with regards your employer, and how much has been paid. However, they are only interested in Tax, the fact You have not been paid is, in their eyes, between you and your employer. Judging from what You wrote, I suspect you talked to Skatteverket more about your not being paid than the taxes not being paid. 4. Taxes not paid - part 2, READ CAREFULLY. If your employer has not paid taxes on your pay, and you cannot prove that you thought he had (do you have pay slips saying what was paid when?), then skatteverket can demand that YOU pay all taxes due on your pay. In Sweden the burden of proof is on the employee in these matters. This is why you need to make sure you have an employment contract and always get a pay advice (lönespecifikation), and make sure on that it shows how much salary was paid, and what deductions have been made for taxes. It sounds to me like your employer has used you as what is known in Sweden as "Black Labour" (svart arbetskraft), which leaves you kind of powerless! |

Hi,
I had an employment contract for 6 months starting from 10th August. My last working day was 19 August but have not received any salary yet. How can I get my salary? I started working on the 20 July but my employer did not register me untill 10 August at Skatteverket in spite of the fact that I had a temporary tax number, thus did not pay taxes after me saying that I have to wait for my residence permit and personnumer. What legal rights do I have as an employee? Thank you in advance for your help. |

you need to clarify a bit... You say you had an employment contract for 6 months that started on 10th August but you finished on the 19th Aug..??
Do you mean you worked only 9 days? Were you fired or did you quit? Do you have a contract on paper or not? Need more info. |
