About paternity leave?

Can the company you work for block a request?

My husband has been in touch with the tax office to find out if he can apply for paternity leave. They informed him that he is now registered and can go ahead, however we are worried that his workplace might decline it. In fact they do not want him to go on leave and are looking for ways to block it. What are his rights and is it even possible?
He has followed company policy in terms of notice period etc. Should we seek legal advice?

Companies can't block it, however do proper research towards the amount of money you'll be missing out on as there is a roof on the amount of compensation you will receive while on leave. It's often not interesting at all to take the leave if you're the higher earner in your family.

Indirectly they can, but only if You have not given the 2 months written notice that You will take it. They cannot block it if You have given the written notice.

The main reason why the Social System pays the parent leave monies, rather than employers, was to remove the stress/control of an employer so that You can enjoy the parent time smile.gif

Remember, if You are in a Union and there is collective agreement, or actually some employers directly, have a benefit where they will top up the basic parent leave payment with an additional sum to 80% of real salary. Those normally have rules about length of service etc... Check.

Remember that You can also reduce working hours to 75% until the child reaches 8yr.

Thank you for the information. 2 months notice has been given and we aware of the cap in monthly payment, however he is not a member of a union.

Guyz can you tell me more about cap. When i had a kid my salary was much lower then my current one. it´s now 35K so will i get money as per my current salary? i have been getting this new salary for about 6 months. i am member of union for 3 years now and i have about 140 days balance after my x took the rest

max 935 kr per day before tax...the longer you go on papaledig, the lower money you get

Regardless if he is a member of he Union or not, he is entitled to take his parental leave as long as the minimum 2 months notice is given and up 80% pay up to the limit that someone mentioned earlier as 935kr per day. You both share up to 480 days of which he must take 60 days. I think the first 380 days are up to 80% and then it's a standard daily rate of 180kr. Some parents share equally and some don't, its your choice as a couple to decide what works best fo you. This parental leave is valid until the child is 8 years old.

Some people determined by their finances can decide to take 5 days each week as paid parental leave and have nothing for the other 2 days of the week in order to extend their time off. Others choose 2 or 3 etc...you can decide.

My Wife is not a member of a Union, but her work gives her a little bit extra per month on top of her parental leave money. Where I work, they don't offer that...unfortunately...but I can't complain as the system here is far superior than a lot of other countries.

When my American cousins came over, they asked me if there was a high divorce rate as they saw lots of Men pushing prams! I explained the system and they were quite envious.

Long time since I took parent leave! smile.gif , but I have a funny feeling You should notify Försäkringskassan of your new salary. If You have had it for 6+ months then they will use that as the basis ... along with all their other wonderful calculations. Your salary of 35K will put You at the max anyway(?).
