Rejection by Migration and Migration court

Residence Permit

I am married to a swedish citizen and i applied for a residence permit and the migration board rejected and we made an appeal to the migration court and it was also rejected.What should me and my wife do as we need to be together?Thanks.

What you should do is prove that your relationship is for real and not just a scam for you to be able to stay in the country.

When we applied, we included pictures from her trips to the US and my trip to Sweden. We had copies of travel documents, theatre tickets and letters from friends who had spent time with us as a couple. We had never lived together and honestly only spent 8 weeks physically in the same place. That didn't seem to bother the board. We were approved easily. Today I had my renewal interview. It was like 8 questions. They said I would probably get my permit early in the week.

What kind of information did you provide? If you are legally married, I can't believe they would turn you down.

I was also easily approved. They said that since we were already married that the application and over the phone interview were merely a formality. Where are you from and where were you married? Something about this does not sound right...

We were married in Gambia and i am also from Gambia and we are legally married and we love each other.Would it be possible if she invite me over to sweden for a visit and i reapply when i get back to Gambia?

There's been a number of cases of middle-aged female divorcees going to West Africa on sex-tourism holidays, meeting a man in his 20s of her dreams, marrying him, bringing him over to Europe to live and then being upset and surprised when said man leaves her for a younger woman or brings his family over from Africa, who Sweden then become responsible for. The migration court will just be making for certain that this isn't going to happen so you need to prove otherwise.

We are in love with each other and also we got married here in Gambia and she is thinking of coming back again.What should we do now as we want to appeal again?

yeah right, you met her for 8 weeks and you are crazy in love and you are married. Once she is here, file for divorce and you are thousand dollars richer.

Being legally married to a Swedish citizen has little significance, what matters is how long You knew each other before You got married etc... if She met you on vacation and you soon got married, then it is reasonable to assume that it was a marriage of convenience rather than a serious relationship.

Swedish women go to Africa for partners like swedish men go to Thailand. Unfortunately for you they are known countries as that are part of the permit shopping merry-go-round. Another factor that weighs against you indirectly is that there has been a growing problem not only with marriages of convenience between Swedish Women and Africans, but also that those are planned by crime organisations as part of the growing drug trade that goes Afghanistan->Gambia->Sweden. sad.gif

Your best bet is as an earlier poster states, take your time, She should come to Gambia and live for a while etc... and show that it is a serious relationship that lasts for some time.

If she is coming back to Gambia then why not be together there? You say that you want to be together, why can`t you both be together but in Gambia?
