If the OPs current employer is a franchise and the UK company has decided to no longer operate a franchise but start a subsidiary in Sweden instead then I'm not certain that the employees have the right to transfer. The "sale" would be a deal to terminate the franchise contract, rather than a straight forward take over.

Thank you all very much for the replies.

As I understand the situation, the company in the UK is "renting" the store from the distributor in Sweden. The store is being run by the UK but I believe the swedish company is still involved somehow.

Do you think I should find out more information before taking this to court?

The quick answer is Yes, and since there is no collective agreement/Union involved You cannot take it to court until after the event. ie. You have to lose your job first.

The main question that needs answering is, is the UK company actually buying the Swedish, or is the owner liquidating the company somehow. Especially since the reason You were given in writing was Selling the business, when your employer could potentially have claimed arbetsbrist!

Right now all You can do is point out that under Swedish employment protection law (LAS) when a company is sold, the employment contracts follow with the company to the purchasing one. ie. Jobs are protected, the sale is considered just a change of owner.

Yes, ask a union lawyer. They might not be able to represent you since you are not a member, but they are always willing to give advice and point in the right directions.
