Man jailed for having sex with sleeping girlfriend

The incident took place in the 19-year-old's home in Västerås after the couple had had an argument, the local Vestmanlands Läns Tidning (VLT) reported.

Following the fight, the girlfriend took some sleeping pills and went to bed.

While his girlfriend was sleeping, the 19-year-old then attempted to have anal sex with her.

She told the court that she was drifting in and out dreams when she sensed someone caressing her, but was soon abruptly awakened by a thrust of pain when the 19-year-old attempted to enter her anal opening.

Following the incident, which took place in late May, the woman was required to take anti-anxiety medication to deal with the mental distress it had caused.

While the 19-year-old claimed he was unaware his girlfriend had taken any medication, she said during the trial that she had indeed informed her boyfriend that she had taken the sleeping pills.

The 19-year-old admitted he had made a mistake, explaining as well that the couple didn't usually engage in anal sex.

But according to the Västmanland District Court, the 19-year-old was fully aware his girlfriend had taken the pills and had attempted to take advantage her helpless state when he tried to have anal sex with her.

As the girlfriend wasn't in a position to consent to the sex act, the 19-year-old's actions constituted rape, the court found.

The court sentenced the 19-year-old to 14 months in prison and ordered him to pay the woman 85,000 kronor ($13,000) in compensation.

If we was found guilty and convicted of RAPE, why is his sentence only 14 months? is rape considered a misdemeanor in Sweden? will he only serve 3 months and be let out on good behavior because of prison overcrowding?

This is just messed up. Even if he will not sit his whole sentence he shouldn't be jailed for that long.

The guy wanted to get advantage of the girl. Clear.

Moreover, he wanted to do something the girl wouldn' t accept in normal circumstances. He has to be punished.

I wonder what would be the reaction of some guys here if the friend with whom they were drinking all the night long has anal sex with them. Perhaps they will say "No problem, he didn't try to kill me with a sword" o perhaps they will invite the friend for a drink next weekend.

It's appalling and unbelievable that anyone here would be trying to defend the guy. He's a rapist pure and simple who decided to take advantage of a woman while she was sleeping and in no position to consent. Who do some men (ie. many of those posting here I suspect) think they have a god given right to anal sex and to demand it regardless of the wishes of their partners?. As MichiganLady points out I doubt most of the men on here would particularly enjoy being woken up by having a dildo shoved up their arse.

The article states he "attempted", and this leads to the question if his actions constitute rape.I personally believe that if he attempted to do something, and regardless what condition she was in she refused or repelled such actions and that was the end of the matter it doesn't constitute rape but more so sexual indignity or whatever the call it in Sweden.

But it's one of these subjects that interests many, but many are unwilling to discuss as it leads to political scape goating under an umbrella of false accusations and sensationalism.

Again, rape is forcing someone to have sex with them against their will.

However sexual attempts which are stopped as soon as the person denies such does not constitute rape IMHO .... But I am sure there will be some real mud slinging.

Go ahead guy...watch another porn video via the internet. Porn has TOTALLY waprped young peoples image og what sex actually is. They think porn stars are loving all the things they do. HELLO! They are ACTRESSES! Bad ones, granted but still actresses. They are PAID, just like hookers to PRETEND to like it. I think the comment of Jacquelinee has raised an important issue - the desensitizing of human beings who are being bombarded by films, internet, magazines, even newspapers where individuals are fed an endless diet of violence, sex, sometimes both and add drink and drugs and I think the young are becoming conditioned to accept behaviour that is devoid of what it means to be human. It seems to me he was trying to have sex in a way that they normally wouldn't agree too and for him it was a chance to experiment? As such he was at best cynical and at worst nihilistic. And some of the comments here seem to be ready to support this brave new world where human beings become less human? He could have left her sleeping peacefully as he should have done and for some reason he didn't. The question is why?

Byke, so if you were medicated and asleep, and suddenly you wake up and feel that someone try to put their penis into your anus you wouldn't press any charges? You would say "well, that was just a sexual attempt, thats totally ok"? I think the had I fight, he was really mad at her, and when he saw that she took that sleeping medicine we saw a chance to really hurt her in the worst way he could imagine. Most men I know would say that whould be their worst nightmare, being raped anally while asleep, but you think thats just "a sexuel attempt"?

This bloke behaved like a cupid stunt, though her pressing charges is debatable.Sentence has been passed,but i would have though sexual assault would have been more appropriate,but i dont suppose there is any jail time for that. Sad for both of them i say....is this the Swedish youth of today?

@Rishonim: Or rather white collar crime leaves a paper trial and is easy to covinct people of. Rape is always difficult though because it often turns into a he-said she-said situation. That's the reason "rape" rarely gets high sentences. It does happen though. A rapist can easily get 10+ years if violent forced sex can be proven to a 100%.

Justice has been served. All forms of violence are grotesque. And the law needs to uphold civility in order to avert chaos such as these. This punitive verdict will come as comforting to the victim. However, the law has sent out a thunderously clear message, and it is very loud indeed.

She can just say "Not tonight honey, I want to sleep".

At no point in the article does it state that even after she declined his offer that he entered her rectum against her will for sexual gratification.

Rape is the action of forcing sex against the will of another.

If the partner only pushed his penis against the rim of his girlfriends rectum, that could be construed as a form of suggestion and some may say assertive (and very creepy if she didn't know the person).

But sexual harassment is very different to rape IMHO.

Knowing what he was about to do "enter her rectum" even if they never had done such a thing before and say "Not tonight honey, I want to sleep"? She was sleeping. She had no idea what he was about to do. Nothing in the article says that he "made an offer and she decline", that's something complety different. He pushed his penis into her anus while she was sleeping. Or is that a offer in your mind? She never had a chance to say "Not tonight honey, I want to sleep" because she was already sleeping.

@Elvine .... If the so called victim had self medicated herself to a state that made her unable to make her own decisions or function in a normal manner then she should have informed her partner at the time or anyone else, which the story clearly states he was not informed.

Just the fact that a young lady has access to such strong prescription drugs makes me question the mental health and subsiquent claims by the prosecution.

Your use of fictional claims to justify the balance as you see fit, makes your opinion untrustworthy. But based on the facts alone, which have been stated and your sexing up of the details ... I don't think it's of any use to discuss this with you.

Even if he hadn't been aware of that fact, and even if she hadn't taken any drugs at all, it's fairly difficult not to notice that the person you're trying to have sex with is actually asleep, and if you'd dispute that then I truly fear for any woman unfortunate enough to find herself in a relationship with you. And your implication that rape is somehow excusable or understandable if the victim has mental health issues is just despicable. JFC, the commenters on this website seriously make me despair for humanity.

The courts judgment in the case and what the defendant stated are 2 separate things entirely.

@byke: And you clearly omitted the part where the court decided he was lying. I'd love to know why you think that you're in a better position to determine the facts of the case than a court of law. A decision was made that her testimony was more reliable than his, for a multitude of reasons that we can't even begin to speculate on. Based on the information in this article, there is no good reason to question that verdict, so I think it's fair to surmise that anyone who does question it is doing so because they're a nasty victim-blaming misogynist. But just for the sake of argument, let's say he really didn't know she'd taken medication. Does that make it excusable? Are you suggesting that he just didn't notice that she was sleeping? Or, as MichiganLady says, do you think that every time a woman goes to sleep she has a responsibility to remind her partner not to rape her?

aha: What sentence is this????. Should a guy have to ask verbally that he want to make sex with his girl in every sex??? that is not natural. 80% sex starts with body language and mens take the first action. If the girl doesnt want , she stops. Then the question of rapping comes if he doesnt stop. The guy started to have anal sex with the girl, and the girl didnt show any negative response for that. He thought she accepted and he continued. what is wrong then?? Then the girl stopped him because she felt pain. And the guy stopped. So should we say this rape???. I can't believe some of the posters on here.

The court found that he knew she had taken sleep meds, the boy said they don't usually have anal sex, and she woke up with him inside her. It was rape.

To even suggest that because they sleep in the same bed, that she was on medication and she didn't specifically tell him not to have sex with her, that it was okay is disgusting.

Like others have posted, if you woke up with a penis or dildo in your arse, I highly doubt that you'd think it was okay.

System, yes, he should ask, either with words or in body language. Usually one can see quite clear in someones eyes if they want to have sex or not. If he gets no response, in words or in body language, he shouldn't continue. Putting the penis into the vagina or ass is usually not the first action people do when they have sex (unless they are rapists or actors in porn films...or teen age boys who think that sex is like that), most people do a lot of things before that, and then they have a lot of time to find out if they want to or not. I find it so extremely weird that there are some people who don't seem to know this things...

Perhaps the judge was looking at the list of penalties for shop lifting? This court needs a new judge.

System, thats not necessary for normal people. They just don't have sex with someone who dont want to have sex. It's very easy. But if you think it necessary to use some kind of form, do that, but I believe that will kill the lust for most people. Very, very few of the rapported rapes leeds to conviction, only a few percent. I guess about 99 % of all rapists are out on the streets and only 1 % are in prison. I think thats scary. Most raped women dont go to the police. They just want to forget about it. And the rapists can continue to rape other women...
