The Local _ Jobs _ Job legality issue

Posted by: hoodrat 6.Nov.2018, 02:36 PM

Wife is about to return to work after a year off from maternity leave, the employer is saying they are happy with my wifes replacement and she won't be managing her department on her return but be working for her replacement.

Is this legal?

Yes, it is legal. The manager has all the right in the world to manage the way he wants. He could also start a redundancy process if you start complaining.

Remember, this is Sweden and you have no rights. All rights are reserved to Swedes.

Probably not.

Some info in EN here: http://www.do.se/other-languages/english/disadvantaging-a-person-on-parental-leave-is-prohibited/
In SV here: http://www.do.se/lag-och-ratt/foraldraledighetslagen/

Is she in a union? They can advise her.

Thanks for this, contacted this organisation and they confirmed to me that with the info I gave them, the employer is not right.

Much appreciated.
