Forced to NOT take Holiday

Is it legal?

Hi! I'm working at a company that has made it mandatory to take 3 weeks of vacation during the summer. That's fine. But then they're saying that we can only take a maximum of 5 days of vacation in addition to that. In other words, we are being forced to save the final 5 days of vacation for next fiscal year. Is that legal?

It is your employer that ultimately decides when you can have vacation.

The only exception to this is that in law during the months of June-July-August, you have the right to take 4 weeks vacation. The employer can request that it be split into 3 weeks together and 1 week elsewhere during that period.

The vacation year runs from 1st April to 31st March and you are entitled by law to 25 days vacation.

With those brief points in mind, it sounds to Me that the employer is saying you cannot take 4 weeks together in summer, must be split 3 weeks + 1 week.

The law says that you have the right to 4 weeks in a row in the summer:
HOWEVER, There can be exceptions to this in the specific Collective agreement (kollektivavtal) that applies (if there is one) - so start by reading that to see what applies.

I have worked as a pharmacist in Sweden and the rule there is max 3 weeks in a row during the summer, not sure how many other industries have this sort of clause in the collective agreement.
