Pirate Bay judges ruled unbiased

The judges appointed to preside over the appeal of the four men found guilty in the Pirate Bay appeals hearing in September have been cleared from bias allegations, the Supreme Court (Högsta Domstolen) ruled on Wednesday.

The allegations were forwarded by financier Carl Lundström and concerned Court of Appeal (Hovrätten) judges Ulrika Ihrfelt and Kristina Boutz. Lundström alleged bias on the grounds of the pair's ties to organizations which support copyright holders.

"A judge before a trial often naturally has an opinion on a legal issue related to the case. This does not mean that he is biased, if he is prepared to follow his convictions regardless of who gains from its application," the court wrote in its judgement.

Lundström, who along with Gottfrid Svartholm Warg, Fredrik Neij and Peter Sunde, was convicted by Stockholm District Court of being an accessory to copyright violations in April 2009. The four men appealed their convictions and are fighting one year prison sentences and a collective fine of 30 million kronor ($4.3 million).

The original appeal was due to be heard in November 2009, but the bias allegations caused the date to be put back and the Court of Appeal hearing is now due to commence in September.

The case is expected to go all the way to the Supreme Court because of its precedent-setting nature: no one in Sweden has ever been found guilty of being an accessory to copyright violations via the BitTorrent file sharing peer-to-peer technology.

Could The Local clarify what:

No s...............t, they are crooked the government placed a great deal of pressure on them on top of the juicy lobby from the studios and labels! Sweden has been competing for the mega contract to host the data backbone of Echelon, this would have brought an obscene amount of revenue for the state an Swedish contractors.

To Sweden´s demise it looks like the Norwegians have had the upper hand, thus the big push from Norway to nominate NOBAMA for the Nobel Peace Prize. Sweden might still get some scraps but it seems Norway will get the lions share of the pie, this seems to be a credible rumor from local IT contractors, and the analyst community.

I hope this goes to the European courts.

I can see the faces of the European court judges when they read evidence that the judges were members of organisations that oppose copyright infringement and then judged a court case prosecuting the Pirate Bay.

I can just see the comments from the European court judges on Swedish justice and the payments to the pirate bay people.

Having an opinion and being a judge is perfectly fine, having ties (or had ties) to different organizations that constantly want to "strengthen" or extend copyright and still judging a copyright case is stupid as bias will naturally enter.

Here's an example, you're a woman judge whose daughter got raped, sure now you have an "opinion" on rape...would you be unbiased if judging rape cases now?

Its astounding to see the amount of open corruption and manipulation of the Swedish govt from private interest groups.

I guess the only conciliation is that its not as bad as the UK where the music industry *LITERALLY* wrote the laws (boingboing.net/2010/03/18/is-the-uk-record-ind.html) or in another example they got a minister to pass the law... a minister who has no *ucking clue and thinks an ip address is an "intellectual property address:boingboing.net/2010/04/08/minister-for-digital.html
