Sweden mulls legality of the baseball bat

Sweden's Supreme Court (Högsta Domstolen - HD) is to consider whether wielding a baseball bat in a public place is against the law.

The case in question concerns a man in Malmö, convicted and fined 1,200 kronor ($184) by the district court in the city for the illegal possession of a dangerous object.

In his defence the man argued that he was using the baseball bat to hit balls for his dog to chase.

Furthermore he argued in his testimony that as he had previous been assaulted on two occasions he felt safer in the knowledge that he had a baseball bat with him in the passenger seat of his car.

According to Swedish law the possession of dangerous items such as knives, and other weapons "designed to be used as a weapon in crimes against life or limb", are not permitted in a public place.

The defendant in the case has argued that a baseball bat is not covered by the law and pointed out that it has a number of other uses.

The appeals court however based its rejection of his appeal on the grounds that he kept it on apparent display in his car, and thus can be construed to conform to the legal definition of a dangerous item.

The Supreme Court on Monday gave the man leave to appeal with a date for the hearing to be announced later.

I guess he should have concealed that bat. Back home in Tennessee, if I had a revolver laying on my car seat, it's illegal. But with my Concealed Weapons Permit, I can keep it hidden and I'm fine. Just have to whip it out when needed!

So put that ball bat in the trunk with the golf clubs and other dangerous weapons.

I'm from Tennessee but I'll tell you something. The Mississippi National Guard could take out Gadhafi with baseball bats, in flatbed wagons in 30 minutes!

What are you talking about?? Baseball bats are used in public places ,Tthe problem is when they are used in non public places like bars. Baseball is a public sport

What's next? If you're pulled over and you have a frying pan in your passenger seat, can't that be used as a "weapon" too? ANYTHING can be used as a weapon. You better be willing to outlaw everything larger than a #2 pencil using this logic.

What's needed is not a ban on baseball bats, but harsher punishments for those who use the bat for violent purposes. The Swedish system of justice is not exactly known for punishing criminals. For if you ban baseball bats, where does one draw the line? The frying pan above is to the point. What about my mothers spike heels? Shall we ban them too? Clearly they are a lethal weapon. And what about ice skates? Walking sticks? CD players? Fishing poles? No this time the Swedish nanny state is, again, going to far. Ban those who want to ban everything!!

If baseball bats are banned then all sports equipment will have to be banned, as well as hammers, screwdrivers, and every other kind of tool. Also, rolling pins and all other kitchen utensils.

And rolled up newspapers.

And sharpened pencils.

All those things are potentially dangerous objects. A skillful assassin could kill you with a pair of nail scissors.

Yeah, I really don't know where this ends.

I remember when I took my first ride on the Stockholm T-banna more than 30 years ago. I saw those flickor with the pert little backsides and thought, "Wow! Now that's some serious weaponry!"

I don't know about here.... haven't been to many home-building sites, but in America the workers wear a toolbelt with hammer, screwdriver, even a portable drill in a holster, and sometimes wear them home or downtown. Wouldn't that be carrying multiple weapons?

It's not the tool that is a weapon, but the way it is carried that intends purpose. A pocket knife in your pocket is not a weapon (unless on an airport), but a 10 cm Morakniv in your jacket might be. A golfclub in your trunk is not a weapon, but keep it on your passenger seat and it is. There is probably no other reason for you to keep it there other than the intention to use it as a weapon. A chef knife in the glove compartment, a chainsaw under the bed, a bowling ball balancing on top of the door....

The officers of the law need to excersise discretion, And they probably did. If I'm going over to the park and carrying my baseball bat to play ball with some friends...that is one thing. If some chav is carrying one around and they act like they are looking for trouble.......that is another.

Anything can be a weapon. A baseball bat use for its intended purpose is not a weapon. But it can be used to inflict serious injury on someone as a weapon.

The main issue here is that Swedes do not play baseball. It is not a common item to have. Its not like the US where everyone has a baseball bat.

Bottom line the government of Sweden is in effect saying they prefer having their citizens preyed upon so that they can investigate their assaults and murders. The police and politicians of Sweden must be quite the group of Sadists.

So in this country if a person manages to save their own life from a criminal the police cannot or will not protect them from are they charged with assaulting the criminal.

Socialist despots will go to any lengths in their efforts to secure ultimate power over those they seek to dominate.

This is another warning to We the People. that Barack Obama and his Socialist agenda must be stopped. A tyrannical government crushing its people's natural right to self defense is abhorrent.
