Court sets date to rule on Assange extradition

The High Court in London will rule on Wednesday on Sweden's bid to secure the extradition from Britain of WikiLeaks founder Julian Assange over rape allegations, the court said on Friday.

"The High Court will hand down judgment in the above case at 9.45am on Wednesday 2 November 2011 at the Royal Courts of Justice, London," said a statement.

Assange was arrested in London in December on a Swedish extradition warrant and is currently living under strict bail conditions at the mansion of a supporter in Britain.

He announced this week that WikiLeaks has been forced to suspend publishing classified files after a funding blockade and could have no option but to shut down by the end of the year.

The whistleblowing website has seen its funding plunge by 95 percent due to an "arbitrary and unlawful financial blockade" mounted by companies including Visa and MasterCard since December last year, Assange said.

The former computer hacker denies the allegations made against him by two Swedish women, arguing that they are politically motivated.

His lawyers argue that his extradition would be "unfair and unlawful".

WikiLeaks has infuriated Washington by releasing tens of thousands of classified diplomatic files allegedly obtained by a US serviceman who is now in prison in the United States.

Many of the files relate to the wars in Iraq and Afghanistan while others contain frank and sometimes embarrassing assessments of world leaders made by US diplomats.

British judges hearing Assange's appeal against extradition to Sweden deferred their judgement in July.

In that hearing, lawyers representing Swedish prosecutors rejected claims that a rape allegation against Assange, made by one of the women, would not be valid under English law.

Swedish lawyers accused Assange's legal team of "winding English law back to the 19th century" with their definition of consent.

Assange's lawyers have also claimed that the European warrant under which he was arrested was invalid because he is only wanted for questioning and has not been charged by Swedish authorities.

If Swedish prosecutors can not get a conviction after all this, Sweden is going to be the laughing stock of the world.

I am sure the Swedish prosecutors will not let that interfere with the way they handle the case.

In Sweden there's no such thing as "Innocent until proven guilty" here you are guilty if the Police and prosecutor says so and evidence be damned, that's up to you to produce!

I've had several trials myself and that is how it always work. If the prosecutor has brought it to court, you're not getting off, because then that would prove the prosecutor wrong, and we can't have that! :-(

The prosecutor tells it "as it is" and then the attorney pleads for leniency before the court sentences. Questioning guilt is pointless, unless you're a cop yourself in which case you can do whatever you want, such as firing a gun wildly into a fleeing crowd.

There is no justice in Sweden.

This whole criminal investigation is politically motivated and managed in Washington. If Sweden is an independant and democratic country it must refrain from slavishly obstructing its own legal process due to US pressure. Remember that the original complaints were dismissed by the prosecutor when she heard them. Suddenly government officials get involved and it is back on again. This whole peresecution, for that's what it is, does not pass the smell test. A government that will corrupt its own judicial system to accomodate a foreign belligerant should be forced to resign en masse.

Ask the US Army private Bradley Manning, who initially released the secret info to begin with if this is a violation of free speech? Generally this type of thing isn't covered under freedom of speech but is considered espionage. Assange on the other hand has been victimized under Sweden's vague and convoluted rape laws.

Assuming that the investigation against Julian Assange is political motivated helps some people to understand this circus. Politics could have played apart after the initial decision but Marieanne Ny as a Swede is fully capable of doing this all by her self. Her decision wasn't negated because in Sweden bystanders to such stupidity usual remain passive.

Some Swedes have terrible trouble making difficult decisions. They panic and any chance of a good decision gets replaced by misfiring neurons badly controlled by the cerebellum. (I would bet my life's worth that a controlled experience with an MRI scan could prove my claim).

Marieanne Ny should have been processing the facts of the case in accordance to the Swedish law. She should have been thinking about the precedent that she was setting up for the future. However when Marieanne Ny re-enstated the investigation, her mind was occupied by the Homer Simpson monkey banging its cymbals. She acted on a cultural impulse to protect woman. She saw that monkey dressed in a bikini hanging off a cartoon cliff and she had to rescue it.

Let's hope justice is finally realized, for we all know if Wikileaks' Assange is extradited back to Sweden, he will either next be extradited, or extreme renditioned, back to the USA for the death penalty there.

Nov. 2nd could be the most expensive day in the history of both Sweden and the UK --- although I'm sure nobody in either of those two countries would ever miss their Internet and WWW access, now would they?????

The peace and prosperity enjoyed in Europe over the last 60 years is due to two things...one the US Marshall Plan, which financed the rebuilding of a shattered Europe while the US opened wide it's huge and lucrative trading, doors which benefited her former enemies at the expense of her own industries. The second thing was the presence of US forces in Europe, and the American nuclear shield, which ensured that Red armies would not be marching further through Europe.

Having liberated hundreds of millions of subjugated Europeans from a brutal German occupation, the US fed and financed them provided the ways and means to wealth and prosperity while defending them at the same time - you would think that Europeans would be a little grateful to the US, but no the reverse is all too true, especially by Germany and France -the very nations who have caused the bulk of European instability and war causalities.

Assange is nothing but a criminal hacker who has exposed those giving information re the security of allied armed forces and friendly governments to the enemies of the free world.It's impossible to believe that anyone in their right mind would condone a bunch of leftists hackers determining what secrets of our governments should be exposed to our enemies.You people really need to enter the real world and look around you at what is happening especially on your own continent.

This will be a lose-lose scenario whichever way the English court decides. Trial by media is not justice. Whether or not Assange committed the crimes he has been accused of is irrelevant in one sense. He cannot now get a fair trial either in England for the extradition hearing or in Sweden, should he be sent back, because of all the press speculation.

The women at the centre of the case may have indeed been raped --- though under English law that charge would not and could not be brought, if the press reports are correct, because the events do not justify such a charge but Sweden law is different. Indeed as has been published here on The Local lately there are weird legal definitions in Swedish law; molestation cannot occur unless the person being molested is awake when it occurs!

Unfortunately for Assange there is no get-out-of-jail card anymore. He authorised the publication of the unredacted cables. Now that anyone can download the CSV file containing the original cables, use the password that "encrypts" the content and read the cables for themselves there is nothing for him to bargain with should the inevitable happen and the CIA get their grubby and blood-soaked hands on him.

You just nail it. Didn't you. Your description of the history of America's input in socio and political history of Europe is correct but unfortunately we don't live in the decades that you describe. The America that liberated Europe in the Second War or protected Europe during the Cold War is not the America of today. Even most Americans would agree with that and we surely should not excuse the despicable behaviour of the Bush governance and administration of the Iraq War based on America's previous greatness.

You are right about the dangers of Pakistan having nuclear weapons. I would have like for America to keep their moral authority and such actions to resolve this issue would be easier.

As for Europeans being whining Leftist losers. Well I've been to Australia recently and if any country is to be classified as cultural moaners or complainers well I am sorry it's you Aussies. HIgh standard of living and heaps of sunshine and beautiful nature but your fellow country men still cry about the cost of living and the small government debt that your country accrued while your 'leftist' government saved the country from the effects of the economic crisis.

Europeans should not get too smug about the good times because they will be soon over, with a PC multicultural Europe being swamped with an ever growing Muslim population which already taking over major European cities, and projections show that most of cities in Europe will have Muslim majorities by 2050 (Worldwide 50% of people under 21 will be Muslims) and that means Sharia Law.

When Jens Orback, Democracy Minister in the Swedish government, said during a radio debate: "We must be open and tolerant towards Islam and Muslims because when we become a minority, they will be so towards us." then you Swedes should have known it was all over for Sweden.You have almost lost your culture and national identity. In the case of Sweden though,that's probably not a bad thing, because it appears most of you Swedes have an inferiority complex -make that a Napolean complex and you are just American haters who never stop spewing your anti American bile while your country goes down the toilet of multiculturalism.

You tick off NODE for making statements that 'almost give America a mythical power for creating evil'. However your statements suffer from the same imbalance.

You make America sound like the White Knight; who is the only purveyor and authority of peace and justice, and prosperity in the mortal world. And your statements also portrays people as thoughtless and powerless on issues concerning their own social and economic stability. It as if you and Hawkeye Ausjtralian want humanity to get our ambition from the American political and military complex and not the valves that established these institutions.

I, on the other hand, believe in the individual to be responsible for their own situation with recognition that we live in communities so we are also have responsibilities. I support WikiLeaks because its methodology assume that most (if not all) human beings are capable critical thinkers who with more transparency have a better foundation to contribute to the peace, justice and prosperity of the world.

WikiLeaks isn't a Left Wing hacking organisation as you two guys would assume. It is actual more American than modern day America.

If people are sick of the debate that merely divide lines between Left and Right, and / or debates conducted with mere statements of opinion from other people who we assume to be authorities on particular topics (as Hawkeye A. does) well get involved in WikiLeaks. Being able to understand the how and why decisions are made by governments and corporates does't make them inoperable. It makes them more accountable and more inclined to make better decision for the community. If more factual information is available for debate, and we get rid of the saturation of opinion articles in the media, then the individual has a better foundation to be a part of a quality discussion. WikiLeaks could become the best chance that we have had for centuries to increase the standard of our critical discourse.

I'm not sure its shocking that so many who leave comments have little grasp of history and show an ugly anti-American racism. By definition those who comment are a self-selecting sample who feel they have something to say. The internet has given them a freedom to preach which they otherwise wouldn't have had and they take it. They are also notable in that they put forward opinions which they take to be such an unassailable truth that they refuse to debate when faced with well motivated counter arguments. Instead they go ad hominem: their opponent is brainwashed, a US-lackey, stupid etc etc.

Regarding US involvement in European history, this of course didn't end after the Cold War. The US put a stop to the Bosnian war after a year or so of European hand-wringing (risking US lives to save Muslim lives, funny how this rarely gets mentioned). It intervened again in Kosovo following more hand-wringing. Even now it still stations substantial forces in Europe and contributes to a security which many absurdly take for granted. We may well feel differently should Moscow suddenly become a bit more assertive as it has long threatened to be (those nuclear weapons never went away). I rather suspect we'd be begging the US to stay and defend us then.

You are no different to the people that you correctly criticize. I have myself often told off Swedish people who simplify and who conveniently forget the good that America's social, economic and military contributed to the European region. However I can't just fill my head with those examples and claim that this means that American actions are always responses based on principles of fairness and justice. Evidence would suggest otherwise.

You should all take that embarrassment that feel about the Iraq War and turn it into something useful so that you can do what you can so that your great America doesn't make same mistakes in the future.

A-Bomb.

When the A bomb was invented no one really knew just what the effects were. After Okinawa and Iwo Jima where the US had over 200 ships sunk or damaged, the allies knew that the landings in Japan were estimated to cost 1 million allied soldiers lives because the Japanese population was going to fight to the death. The Japanese were warned that America had this weapon and gave them the option to surrender. The warnings were ignored and the US dropped the first bomb.So why didn't the Japanese surrender right then and there? You can sit smugly,cosy and warm and self righteous sipping a latte behind your PC, but if you were one of the hundred of thousands of allied troops that had to land on Japanese beaches and endure Kamikaze planes and suicide attacks you would not be so smug and judgemental.

And why should one more allied soldier have died taking Japan? Why should one more allied family have lost their father or son fighting a ruthless barbaric enemy? Japan attacked China and then the US and Britain in an undeclared and unprovoked war, yet you want the allies to fight with kid gloves on and lose hundreds of thousands of troops at least just so you can feel fuzzy and warm and pleased with your oh so magnificent humanity, unlike those barbaric Americans who should have had the decency to slug it out foxhole to foxhole, house to house. How dare they take a short cut and end the war to save allied lives

And FYI. America gave the Japanese their democratic constitution and help rebuild Japan to what it is to the powerhouse of today.

Incidentally what part did Sweden play in the liberation of the nations in the Pacific? Oh I forgot -neutral so there was no chance of any sanctimonious Swedes dying on the beaches of Japan. And while your Great Satan Americans were fighting and dying for the liberation of Europe and the Pacific, neutral Sweden's economy was almost fully integrated into the Nazis' New Order; Sweden supplied Germany with high-grade iron ore (30 percent of that used by the German armaments industry), as well as ball bearings, foodstuffs, wood, and many other raw materials. In matters of finance, the Swedes cooperated with Germany by providing credit, which allowed the delivery of vast quantities of military equipment to the Wehrmacht..

Geez -no wonder you Swedes bash America. With a history like yours. I too would be ashamed and want to turn attention to another country...And where better than America?

Strawman arguments you say. Out of all that I wrote in relation to your thread and your fellow bloggers (John. and Hawke.), what you decide to approach me with is my assumption that the Americanism that you support is based on fairness and justice.

To tell you the truth I am one of those ignorant lefties that you despise so much. I was bored and I had no patients of writing a honest blog so I set out just to see how much ranting crap I could entice out of Hawkeye Ausjraltian. That was entertaining and my fellow readers of this blog got to learn a heaps of interesting stuff, and he is still writing.

My logic comes from the following: not once did you or your blog buddies mentioned or show any consideration for why this anti-Americanism has grown over the last decade. So I already knew that the Americanism that you talked about had nothing to do with fairness and justice. I just wanted to hear one you say it.

Why should we have to listen to such rants that supports a country responsible for the War that become a corporation-money-pig-feast, that killed so many civilian, that awarded military contracts to certain politicians and took valuable money away from the American people. If America has lost respect around the world well it's their own fault. Your apologetic attitude and historical reminiscence wont convince anyone.

Many of us are worried about what type of Americanism will exist in the future. You have already told us that it does not necessary have to be about justice or fairness. So what will be the reason for the next conflict? Corporate Need!

As for the great USA protecting us Europeans, I would rather use the straw from my arguments. Given the USA's incompetence during the Iraq War I would rather that you guys sit the next one out, and if you did that, then there isn't really any pending war anyway. Until there is a real threat against 'fairness and injustice of humanity' I would suggest that you help re-establish the values that made the USA proud during the Second World War and the others wars that you have mentioned. Yes the US is the ONLY country to use an atomic bomb on another country.

An estimated 200,000+ people died in the 2 bombings. In the Japanese occupation and rape of the city of Nanking China over 300,000 Chinese died. On May 23 and 25th the US Army air force using conventional weapons destroyed over 56 square miles of Tokyo and killed over 200,000 people. WAR is hell.

The US did not create the Taliban.

During the Russian occupation of Afghanistan the US funded THROUGH the Pakistan ISI the Afghan mujahideen, the Pakistan ISI diverted much of these funds to the Afghan- arabs (later known as al Qaeda). Mullah Omar and other mullahs then formed the taliban and took over most of the country. The taliban are fanatical islamist, they destroyed the national Afghan museum and the two statues of Buddhas built in the 6th century because all of it was unislamic.

The Al-qaeda organization was set up in 1989 when the Russian Army left Afghanistan. Many volunteers from Arab countries had gone to Afghanistan during the 1980s. They wanted to help the Afghans fight the invading Russian army. When the Russian army was defeated al-Qaeda was set up to continue the Jihad against people the volunteers thought were enemies of Islam.

Actually it started in the late 70's. The US looked at Saddam as a bulk-ward against communist Russian incursions into the Persian gulf along with the Shah of Iran. Then he discovered he could get more from the Russians. Like salman pak his WMD factory

The question keeps getting asked what is America doing for the world now?

The 2008 reauthorization of PEPFAR expands the U.S. commitment to $48 billion over 5 years to combat HIV/AIDS, tuberculosis, and malaria.

The US will contribute $105 million dollars for this year for aid to Somaia.It has already given $73 millioneven though in the last two weeks America has gotten close to a default on her credit.Your friends China and Russia haven't given a cent and China holds something like $12(?) trillion of US dollars.

America is a also the major contributor by far in feeding over 100 million peopl in 77 of the world's poorest countries.

More than than 200,000 US Peace Corps volunteers have worked in third world countries all over the world.

The US Navy ensures world wide that the sealanes remain free for international trade. That means Sweden can get Saab car exports from China with no worries. China incidentally is claiming the entire South China Sea as it's own and threatening her neighbours ,including Vietnam and they have ask the US for help. Don't think we will see any Swedish ships in the fray when push comes to shove though.

The US also keeps her huge military around the world to combat terrorist and rogue countries, some who are seeking to build bio, chemical and nuclear weapons. America also has stationed something like 48,000 troops in harms way on the South/North Korean border for the last 60 years. America lost 50,000 young soldiers when North Korea invaded South Korea. Are the South Koreans grateful? Hell no.

This is just a verys mall part of what your despised America does for the world -of course you would never know it in Europe where your little socialist poisoned minds can only think of what America might do that doen't fit in to your Swedish P C "all cultures are equal except American" agenda.Oh and America has been awardered 326 + Nobel Prizes, mostly in science, chemistry, engineering and medicine. All these to make your lives better and healthier.

So someone -answer the question-What has Sweden done for the peace and security of the world at any time in history? Maybe all you Swedes can do is rubbish the one country that actually accomplishes anything worthwhile.And if you can't answer the question then that just proves it.
